<br />POOL :~~"'U';:::URE AFfIDAVIT <br /> <br />It'is understood and agrp.ed that t~e OWNER will comply with the following <br />regulations concerning pool enclosure: <br /> <br />1. That immediately upon completion of pool construction the OWNER shall: <br /> <br />a. Construct around the pool a four foot high fence with self latching <br />gates with no openings large enough to a\1mit a four inch sphere: or <br /> <br />b. Construct a screen enclosure around the pool which is permitted by the <br />Pasco County Central Permitting Division. <br /> <br />2. That one of the enclosures described above will be completed prior to final <br />inspection of the pool. ' <br /> <br />3. That the OWNER will reql.\ire his pool contractor and screen enclosure <br />contractor (if applicabJ'e) to call for a final inspection immediately <br />following the struct'.n~e~; completion. <br /> <br />" . If the following condl..t.;,ons are fO\md on the property. it shall comprise <br />presumptive evidence that the OWNER is in violation of Section 315 of the <br />Standard Swilllling Pocl. Code and Section 530,4-D of the Pasco County Land <br />Development Regulatio~2= <br /> <br />a. Hore than seven dayE. have passed since all work was completed on the <br />pool structure except for a fl.aal inspection. and; <br /> <br />1) A fence or pool enclosur~ as described above is not in place: or <br /> <br />2) work to build a fence or pool enclosure as described above has not <br />commenced and is proceeding in good faith; or <br /> <br />b. The pool is being used for swimming or bathing purposes without a fence <br />or screen enclosure. as described above. <br /> <br />5. That a violation of Section 315 of the Standard Swimming Pool Code or <br />Section 530.4-D of the Pasco County Land Development Regulations shall <br />result in the issuance of a "Notice of Violation" to the OWNER by the Pasco <br />County Building Official; and may result in a fine not to exceed $500 for <br />each day that the viola!',ion exists. <br /> <br />6.
