<br />CONSTRUCTION CONTRACT <br /> <br />GUDE BROTHERS CONSTRUCTION COMPANY <br />12349 Curley Street <br />Post Office Box 1400 <br />San Antonio, Florida 33576-1400 <br />(904) 588-2750 <br /> <br />OWNERS NAME(S): <br />AND ADDRESS <br /> <br />Charter Hospital of Pasco <br />21808 State Road 54 <br />Lutz, Florida 33549 <br /> <br />DATE: <br /> <br />July 13, 1994 <br /> <br />JOB LOCATION: <br /> <br />38435 North Avenue, Zephryhills, Florida <br /> <br />THIS AGREEMENT is made and entered into the date above written by and <br />between GUDE BROTHERS CONSTRUCTION COMPANY, the Contractor (CONTRACTOR), and the <br />above-named owner(s) (OWNER), wherein IT IS MUTUALLY UNDERSTOOD, STIPULATED, <br />COVENANTED AND AGREED BY AND BETWEEN THE PARTIES HERETO AS FOLLOWS: <br /> <br />1. Description of Work: The CONTRACTOR shall perform the following described <br />work in accordance with the contract, plans and specifications, herein <br />called "Contract Documents", at the above-described job location. SUMMARY <br />OF WORK TO BE PERFORMED: As per the attached Proposal dated July 6, 1994, <br />including alternate. <br /> <br />2. Agreed Payment to Contractor: The OWNER agrees to pay the CONTRACTOR for <br />the work described the total payment or contract sum of: <br />Ten thousand, thirty and no/100s DOLLARS ($10,030.00). <br />The OWNER shall make progress payments on the account of the contract sum <br />to the CONTRACTOR on the basis of applications for payment submitted to <br />the OWNER or the OWNER'S Architect by the CONTRACTOR as the work <br />progresses. The OWNER agrees to pay to the CONTRACTOR the fOllowing <br />percentages of the contract sum upon completion of the following phases of <br />construction: 90% upon Substantial Completion, 10% upon Final Completion <br />Payment due within 10 days of invoice <br /> <br />3. Contract Period: The CONTRACTOR shall commence work under this contract <br />within fifteen (15) days of the issuance of the building permit, and <br />CONTRACTOR shall work diligently to complete the work as soon as possible, <br />consistent with principles of good workmanship and with no unnecessary <br />delays other than those caused by the weather and acts of God. <br /> <br />4. Contractor's Affidavit: Upon completion of this project, the CONTRACTOR <br />shall furnish to the OWNER a Contractor's Affidavit affirming that all <br />labor, materials and equipment for the project and all subcontractors have <br />been paid in full. CONTRACTOR will further furnish a complete release of <br />all liens arising out of the contract, or in the alternative, a bond <br />satisfactory to the OWNER indemnifying the OWNER against such liens. <br />
