POOL ENCLOSURE AFFIDAVIT j)-, It is understood and agreed that the OWNER will comply with the following regulations concerning pool enclosure: 1. That immediately upon completion of pool construction~ the OWNER shall: a. Construct around the pool a four (4) foot high fence with self- closing, self-latching gates with no openings large enough to admit a four (4) inch sphere; b. Construct a screen enclosure around the pool which is permitted by the Pasco County Central Permitting Division; or ~ c. In the case of a portable above-ground spa, provide an impenetrable spa cover securely fastened over the structure when not in use. 2. That one of the enclosures described above will be completed prior to final inspection of the pool. 3. That the OWNER will require his/her pool contractor and screen enclosure contractor (if applicable) to call for a final inspection immediately fol- lowing the structure's completion. 4. If the following conditions are found on the property. it shall comprise presumptive evidence that the OWNER is in violation of Section 315 of the Standard Swimming Pool Code and Section 530.4-0 of the Pasco County Land Development Regulations: a. More than seven (7) days have passed since all work was completed on the pool structure, except for a final inspection, and: (1) A fence or pool enclosure as described above is not in place; or (2) Work to build a fence or pool enclosure as described above has not commenced and is proceeding in good faith; or b. The pool is being used for swimming or bathing' purpOSE!S without a fence or screen enclosure as described above. 5. That a violation of Section 315 of the Standard Swimming Pool Code or Sec- tion 530.4-0 of the Pasco County Land Development Regulations shall result in the issuance of a "Notice of Violation" to the OWNER by the Pasco County Building Official and may result in a fine not to exceed ~i500.00 for each day the violation exists. 6. If the signature of the OWNER'S AGENT appears below, the AGENT promises in good faith to make the OWNER aware of the above-described requirements and penalties before commencing construction.
