In event that PURCHASER and Permaguard mutually agree to changes in the work above described. any resulting reviskYi in price. or description of work, shall be written and signed by <br />both parties, and shall be a part of this contract as though originally wrrtten herein. <br />4. Uauidated Damaoos As actual damages for breach of the contract prior to commencement of work are difficult to ascertain ard are uncertain, the parties agree as follows: <br />(a) Prior to commencement of work or furnishing of materials, Ten Percent( 1 0%) of the cash price stated in the contract (or the maximum amount allowed by Florida law) will be considered <br />as liquidated damages, and not as penalty or forfeiture. <br />(b) Once labor, services and/or materials are commenced, Permaguard Industries, Inc. will be entiUed to actual damages upon Purchaser's breach of the contract. (Actual damages are defined <br />as the actual cost of labor. services. and/or materials to the date of the breach of contract. plus 10%). <br />5. Attorney's Fees. In the event it becomes necessary for Permaguard to enforce any part of this contract and should Permaguard prevail, Purchaser agrees to pay Permaguarcfs reasonable <br />attorney's fees and all costs of this action. <br />.6. This contract shall be for the benefit of ard be binding upon the respective heirs. administrators, successors ard assigns of the parties. <br />7. This contract is not binding on Permaguard unless accepted on behalf of Permaguard. by an officer of Permaguard. <br />8.
