~ Emerald Pointe RV Resort Stipulated Sum Construction Contract This contract is made this 23rd day of October, 1995, by and between The Emerald Pointe Corporation, hereinafter called Owner, Thomas Sign & Awning Co., Inc., hereinafter called Contractor. ARTICLE I. WORK: Contractor agrees to furnish all equipment, materials and perform all labor necessary to complete the sign for The Emerald Pointe R V Resort according to the general conditions of this contract, as per the drawings and specifications prepared by Contractor, to the full satisfaction of the Owner and Owner's engineers. ARTICLE II. INSPECTIONS: Contractor agrees to call for any and all inspections required by the work described herein and to have a qualified representative on site during such inspections. TIME: Contractor agrees to diligently pursue completion of the work ARTICLE III. CLEAN-UP: Contractor agrees to remove any and all debris, on a continuing basis, from the job-site as may be a result of the performance of the work described herein or Owner may ded~ct from contract all such charges borne by Owner to effectuate said clean-up. ARTICLE V. EXTRAS: No deviations from the work specified in this agreement will be permitted or paid for unless a WRITTEN EXTRA WORK/CHANGE ORDER is first agreed upon and signed by Owner and Contractor. ARTICLE VI. ASSIGNMENT: No assignment of this agreement is permitted without the prior written consent of Owner. ARTICLE VII. INSURANCE: Contractor agrees to obtain and pay for Workman's Compensa!ipn Insurance, Public Liability Insurance, Property Damage Insurance, and any other insurance coverage which may be reasonably required by Owner, Federal, State, City, or County laws.
