<br />POOL ENCLOSURE AFfIDAVIT <br /> <br />'j)-, <br /> <br />It is understood and agreed that the OWNER will comply with the following regulations <br />concer~ing pool enclosure: <br /> <br />1. That immediately upon completion of pool construction. the OWNER shall: <br /> <br />a. Construct around the pool a four (4) foot high fence with self- <br />closing. self-latching gates with no openings large enough to admit <br />a four (4) inch sphere; <br /> <br />b. Construct a screen enclosure around the pool which is permitted by <br />the Pasco County Central Permitting Division; or <br /> <br />t' <br />c. In the case of a portable above-gro~nd spa, provide an impenetrable <br />spa cover securely fastened over the structure when not in use. <br /> <br />2. That one of the enclosures described above will be completed prior to final <br />inspection of the pool. <br /> <br />3. That the OWNER will require his/her pool contractor and screen enclosure <br />contractor (if applicable) to call for a final inspection immediately fol- <br />lowing the structure's completion. <br /> <br />4. If the following conditions are found on the property. it sh-all comprise <br />presumptive evidence that the OWNER is in violation of Section 315 of the <br />Standard Swimming Pool Code and Section 530.4-0 of the Pasco County Land <br />Development Regulations: <br /> <br />a. More than seven (7) days have passed since all work was completed on <br />the pool structure. except for a final inspection. and: <br /> <br />(1) A fence or pool enclosure as described above is not in <br />place; or <br /> <br />(2) Work to build a fence or pool enclosure as described above <br />has not commenced and is proceeding in good faith; or <br /> <br />b, The pool is being used for swimming or bathing' purposes without a <br />fence or screen enclosure as described above. <br /> <br />5. That a violation of Section 315 of the Standard Swimming Pool Code or Sec- <br />tion 530.4-0 of the Pasco County Land Development Regulations shall result <br />in the issuance of a "Notice of Violation" to the OWNER by the Pasco County <br />Building Official and may result in a fine not to exceed $500.00 for each <br />day the violation exists. <br /> <br />6. If the signature of the OWNER'S AGENT appears be low. the AGENT promises in <br />good faith to make the OWNER aware of the above-described requirements and <br />penalties before commencing construction. <br /> <br />SWORN AND SUBSCRIBED <br />it <br />~.
