<br />2 This contract covers all materials and/or labor specified above but does not include costs resulting from causes not reasonably known to Permaguard prior to exea..rtion of this contract inclLding
<br />but rot limited to costs inOJrred bringing existing structures into compliance with building codes, costs incurred by compliance with revision in building codes. abnormal site or grading requirements,
<br />exislence or locatIon of WIres, popes, sewers or utilijies. Any such costs to be paid by PURCHASER.
<br />3 In event that PURCHASER and Permaguard mutually agree 10 changes in the woc1c above described, any resulting revision in prICe, or description of work. shall be wrijten and signed by
<br />bolh parties. and shall be a part of this contract as though originally wri1ten heretn.
<br />4. UQuidated Damaoes As actual damages for breach of the contract prior to commencement of work are difficult to ascertain and are uncertain, the parties agree as follows
<br />(al Prior to commencement of woc1c or furnishing of matenals, Ten Percent( 1 0%) of the cash price stated in the contracl (or the maximum amount allowed by Florida law) will be considered
<br />as liquidated damages, and not as penalty or forfeiture.
<br />(b) Once labor, services and/or materiats are commenced, PermagLl3.rd Industries, Inc. will be entitled to actual damages ~on Purchaser's breach of the contract (Actual damages are defined
<br />as the actual cost of labor, services, and/Of materials to the date of the breach 01 contract, plus 10%).,
<br />5. Attorney's Fees. In lhe event it becomes necessary for Permaguard to enforce any part of this contract and should Permaguard prevail, Purchaser agrees to pay Permaguard's reasonable
<br />a1torney's fees and all costs of thIS action.
<br />6. This contract shall be for the benefit 01 and be binding upon lhe respective heirs. administrators. successors and assigns of the parties.
<br />7 This contract 's not binding on Permaguard unless accepted on behalf of Permaguard, by an oNicer of Permaguard.
