Zepi;lyrhills, <br />which was damaged by: sinkhole on the following date: 06/13/97 FL <br />IN CONSIDERATION of the mutual terms set forth below, the parties agree as <br />follows: <br />SCOPE OF WORK AND COST: The extent of repairs, the manner in which the <br />work is to be done, and the cost will be in accordance with an estimate prepared <br />?y BlIi Iders Construc.tion. Owner shall <br />allow Builders Const!lction Company unencumbered access to the premises to <br />complete the work, <br />PAYMENT: Owner directs the insurance company to make draft or check for <br />the repairs payable to "Builders Construction Company of Lakeland, Inc." At the <br />time t'epairs are complt:,ted, Owner shall pay an additional amount :11 cash for the <br />deduc l. i ble, depreciat Lon, upgrading, and any additional work d,ne at Owner's <br />request that is not included in the insurance estimate of damages. Any upgrading <br />or additional work sh~ll be agreed upon in written form before hork is started <br />between Owner and Builders Construction Company, <br />REMEDIES: Owner agrees to pay collection expenses, including reasonable <br />at torney's fees if it becomes necessary to collect this accolln t through legal <br />actilJll. In the event that litigation is commenced to enforce any of the terms <br />and c:ondi tions of thi s Agreement, the prevai ling party shall be enti tled to <br />reimbursement for costs and attorney's fees in addition to any other relief <br />graIlted the prevailing party by a court of competent jurisdicti6n.
