JOB SITE(S): TA33XC047 CONSTRllCTION ORDER NO. z.cphn'hills JOB SITE CONSTRUCTION ORDER (Basis of Payment - Stipulated Sum) THIS JOB SITE CONSTRUCTION ORDER (the "ConstructIOn Order") IS Issued wlder that Master ConstructIOn Agreement, dated the 2 day of February, 1999 (the "Master Agreement"), between SprlntCom, Ine a Kanas corporation ("Company), with its place of business located at 2330 Sha~ee Mission Parkway, Westwood, Kansas 66205, and MasTec Nurth America d/b/a Mastee Wireless Services, a Flurida Cumpany ("Contractor). with its principal place of business located at 3155 NW""" Avenue, Miami, FL 33122. The effective date of this Constmction Order is __, 20_ (the "Effective Date"). The Company. directly or through aHiliates, holds licenses from the Federal Communications Conunission CfCC") to provide wireless personal communications services ("PCS") in certain portions of the United States. The Company is building a PCS network throughout portions of the United States (the "Project"). The Work to be performed by the Contractor is the constIUction and/or installation of all or a portion of one or more wireless telecommunications sites constituting a portion of the Project. The Work is more completely described in the Contract Documents (hereinafter defined). . . Company and Contractor agree lis set forth below. The Contract lCplese:nts the entire and intepated agreement.between the parties hereto and supersedes prior negotiations, representations or agreements, either written or oral. The Con1:ract Documents do not include the bid documents, and all bid documents are superseded by the provisions of the Contract Documents. ARTICLE 2 THE WORK The Contractor will perform the entire Work as described in the Contract Documents, except to the extent specifically indicated in the Contract Documents to be the responsibility of others. ARTICLE 3 DATE OF COMMENCEMENT AND SUBSTANTIAL COMPLETION The date of commencement is the date from which the Contract Time is measured, and will be the Effective Date written above, unless provision is made for the commencement date to be fixed in a notice to proceed issued by the Company. Unless the commencement date is established bv a notice to proceed issued by the Companv, the Contractor must notifv the Company in writing not less than five (5) days before commencing the Work to permit the timely liling of mortgages, mechanic's liens and other security interests. The Contractor mllst achieve Final Completion of the Work not later than thirty (30) days after the date of commencement (the "Contract Time"), subject to adjustments to the Contract Time as provided in the Master Agreement. In the event Contractor docs not achieve Final Completion within the Contract Time (as it may be amended under the Master Agreement), Contractor must pay Company as liquidated <L'Images, and not as a penalty. the a~olmt of $ per day (or any portion thereof) beyond the Contract Time until the Work has been completed in accordance wlth the Contract Documents (the "Liquidated Damages").
