<br />3, In event that PURCHASER and Permaguard mutually agree to changes in the work above described, any resuiting revision in prics, or description of wOrk, shall be written and signed by
<br />both parties, and shall be a part of this contract as though originally written herein,
<br />4, Liquidated Damaoes As actuai damages for breach of the contract prior to commencement of work are difficult to ascertain and ars uncertain, the parties agree as follows:
<br />(a) Prior to commencement of work or furnishing of materials, Ten Percent( 1 0%) 01 the cash price stated in the contract (or the maximum amount allowed by Florida law) will be COnsidered
<br />as liquidated damages, and not as P.enalty or forfeiture,
<br />(b) Once labor, services and/or materials are commenced, Permaguard industries, Inc, wili be entitled 10 actual damages upon Purchaser's breach ofthe contract, (Actual damages are defined
<br />as the actual cost of labor, services, and/or materials to the date of the breach of Contract, plus 10%).
<br />5, Attorney's Fees, In the evenl It becomes necessary for Permaguard to enforce any part of this contract and should Permaguard prevail, Purchaser agrees 10 pay Permaguard's reas~nable
<br />attorney's fees and all costs of this action.
<br />6, This contract shall be for the benefrt of and be binding upon the respective heirs, adminislrators, successors and assigns of the parties,
