<br />2. A new paragraph I of Article XXIII is added and shall <br />read in its entirety as follows: <br />I, The Grantor reserves the right during the <br />Grantor's lifetime to reside upon any real property <br />transferred to this trust that is the Grantor's <br />principal residence. It being the intent of this <br />provision to retain for the Grantor the requisite <br />beneficial interest and possessory right in and to such <br />real property to comply with section 196.041, Florida <br />Statutes, such that such beneficial interest and <br />possessory right consti tute in all respects "equitable <br />title to real estate" as that phrase is used in Section <br />6, Article VII, of the Consti tution of the State of <br />Florida, Notwithstanding any contrary provision of <br />this Agreement, the Grantor's interest in any such real <br />property in which the Grantor resides pursuant to the <br />provisions of this trust shall be deemed to be an <br />interest in real p~operty and not personalty and shall <br />be deemed the homestead of the Grantor. <br /> <br />3. In all other respects, except as hereinabove amended, <br /> <br /> <br />Grantor ratifies and confirms all of the provisions of Grantor's <br /> <br /> <br />said Revocable Trust of 1993, as executed on the 26th day of <br /> <br /> <br />August, 1993. <br /> <br />3 <br />
