<br />NOTICE: ANY HOLDER OF THIS CONSUMER CREDIT CONTRACT is SUBJECT TO ALL CLAIMS AND DEFENSES WHiCH THE DEBTOR

<br />1, The contract herein written is the complete understanding between the parties, and no oral modifications or amendments shail be made, except in writing and signed
<br />by both parties,
<br />2, This contract covers ail materials and/or labor specified above but does not include costs resulting from causes not reasonably known to Permaguard prior to execution
<br />of this contract including but not limited to costs incurred bringing existing structures into compliance with building codes, costs incu rred by compliance with revision
<br />in building codes, abnormal site or grading requirements, existence or location of wires, pipes, sewers or utilities, Any such costs to be paid by PURCHJ>,SER,
<br />3, In the event that PURCHASER and ?ermaguard mutuaily agree to changes in the work above described. any resulting revision in price, or description of work, shall
<br />be written and signed by both parties, and shali be a part of this contract as though originaliy written herein,
<br />4, Liquidated Damaaes, As actual damages for breach of the contract prior to commencement of work are difficult to ascertain and are uncertain, the parties agree as foliows:
<br />(a) Prior to commencement of work or furnishing of materials, Ten Percent (10%) of the cash price stated in the contract (or the maximum amount aliowed by Florida
<br />law) wili be considered as liquidated damages, and not as penalty or forfeiture,
<br />(b) Once labor, services. and/or materials are commenced. Permaguard Industries. Inc, wili be entitled to actual damages upon Purchaser's breach of the contract.
<br />(Actual damages are defined as the actual cost of labor. services, and/or materials to the date of the breach of contract plus 10%),
<br />5, Attorney's Fees, In the event it becomes necessary for Permaguard to enforce any part of this contract and should Permaguard prevail, Purchaser agrees to pay
<br />Perrnaguard's reasonable attorney's fees and ali costs of this action,
<br />6, This contract shall be ior the benefit of and be binding upon the respective heirs, administrators, successors and assigns of the parties,
<br />7. DO NOT SIGN UNTIL YOU HAVE REJI.D ALL OFTHiS,AGREEIvIENT. The undersigned PURCHASER(S) acknowledge receipt of a true copy of this instrument with
<br />all blanks suitably filied, (IN WITNESS WHEREOF) this contract has been signed by the PURCHASER and by SALESMAN, the day and year first above written,

<br />agreement by providing written notice to the seller in person, by telegram, or by mail. This notice must indicate that you do not
<br />want the goods or services and must be delivered or postmarked before midnight of the third business day after you sign this
<br />I agreement. If you cancel this agreement, the seller may not keep all or a part of any cash down pa ment."
