<br />ARTICLE 3. - TIME OF COMMENCEMENT: No work shall be commenced by the Contractor until he <br />has received a written Notice to Proceed from the Pasco County Community Development Division. The Notice <br />to Proceed will be issued within thirty (30) days from the date of the Contractor signing this Agreement, or if it is <br />not, the Contractor has the option of withdrawing his bid and proposal. Work shall begin no later than seven (7) <br />days after the Notice to Proceed is issued. If work is not completed within agreed upon time period, Contractor <br />will be penalized Fifty and 00/100 Dollars ($50.00) per day liquidated damages for every normal working day <br />until completion, unless approval for extension has been agreed upon in writing by Owner, Contractor, and the <br />Community Development Division. This provision is contingent upon strikes, accidents, Acts of God, or other <br />events beyond the control of Pasco County and the Contractor. <br /> <br />ARTICLE 4. - PAYMENT: The Contractor will be paid according to the draw schedule after the <br />Community Development Division conducts an inspection certifying that the work has been completed according <br />to the contract. Final payment due the Contractor will be made after the Contractor has furnished the Owner, in <br />care of the Community Development Division, satisfactory release of liens or claims for liens by subcontractors, <br />laborers, and material suppliers for completed work or installed materials. All such releases must be notarized. <br />Payments will be made within thirty (30) days of receipt of pay request by the Pasco County Finance <br />Department. <br /> <br />ARTICLE 5. - CONTRACTOR'S INSURANCE: The Contractor shall be responsible for all damages to <br />person or property that occur on the job site or adjacent thereto as a result of his fault or negligence in <br />connection with this contract. The Contractor shall, prior to commencing work, furnish evidence of required <br />comprehensive liability insurance. The Contractor shall also furnish evidence of coverage in accordance with <br />Florida Workers' Compensation Laws. <br /> <br />ARTICLE 6. - SUBCONTRACTS: All subcontractors shall be bound by the terms and conditions of this <br />contract insofar as it applies to their work, but this shall not relieve the General Contractor from the responsibility <br />to the Owner for the proper completion of all work to be executed under this Agreement, and he shall not be <br />released from this responsibility by any subcontractual agreement he may make with others. The Contractor <br />shall be required to furnish to the Owner and Community Development Division in writing, a list of the names of <br />the subcontractors proposed for the principal portions of the work within ten (10) days of the Notice to Proceed <br />if requested. The Contractor shall not employ any subcontractor to whom the Owner or the Community <br />Development Division may have a reasonable objection. <br /> <br />ARTICLE 7. - GENERAL RESPONSIBILITIES OF THE CONTRACTOR: <br /> <br />7.1 <br /> <br />7.2 <br /> <br />7.3 <br /> <br />7.4 <br /> <br />7.5 <br /> <br />molp020702l17(2) <br /> <br />The Contractor shall be licensed and supervise and direct the work using his best skills <br />and attention. <br /> <br />The Contractor shall provide the Owner and Community Development Division with <br />evidence that he has secured and paid for all licenses and permits necessary for the <br />proper execution of the work; and, upon completion of the job, shall provide evidence that <br />all work has been inspected and approved by the appropriate building inspectors. <br /> <br />The Contractor shall not employ on the work any unfit person or anyone not skilled or <br />licensed, if appropriate, in the task assigned to him. <br /> <br />The Contractor shall be responsible for the acts and omissions of all his employees, and <br />all subcontractors, their agent and employees, and all other persons performing any of the <br />work. <br /> <br />The Contractor shall not assign this contract without written consent of the Owner and the <br />Community Development Division. Any request for assignment must be addressed to the <br />Community Development Division. <br /> <br />-2- <br />
