<br />LEASE AGREEMENT /0) A - ~ <br />-svJf~ <br />THIS LEASE AGREEMENT made and entered into this 1st day ofMay, 2003 by <br />and between William F. Nye and Andrea R. Nye, 5306 Fox Hunt Drive, Wesley <br />Chapel, FL 33543, (813) 973-4256, hereinafter called the Landlord and Michael L. <br />Mann and ~erein after called the Tenants. <br />WHEREIN, IT IS ~~RSTOOD, STIPULATED, COVENANTED AND AGREED, <br />By and between the parties as follows: <br /> <br />1. DESCRIPTION OF PREMISES: Landlord hereby leases and demises unto <br />the tenant the premises known as Northside Plaza, 6305 Gall Blvd, Zephyrhills, Pasco County Florida <br />33541 being one of two rental wits located in the building, owned by William F. and Andrea R. Nye, the <br />Landlord, situated at 6305 GaD Blvd and containing approximately 1,200 square feet. The Tenant is also <br />granted the right in conjunction with other tenants to use the common parking areas, driveway, <br />hallway, sidewalks and means of ingress and egress subject to the limitations set forth <br />below. Tenant shall be subject to reasonable rules and regulations for use thereofas <br />prescribed from time to time by Landlord. <br /> <br />2. TERMS: The terms of this lease shall be for a period of One. Year, <br />commencing on the~ 0.~~03J~A ~ting on the 1st day of May 2004. <br /> <br />Lease y~fined. tfi~ term "traiJ year" as used in this Lease shall <br />mean a period of twelve (12) full consecutive calendar months. The fIrst lease year shall <br />begin on the date of commencement of the term hereof if the date of commencement of <br />the term hereof shall occur on the first day of a calendar month; if not, then the first lease <br />year shall commence upon the first day ofthe calendar month next following the date of <br />commencement upon the anniversary date of the fIrst lease year. <br /> <br />3. RENT: The tenant shall pay to the Landlord, a monthly rental of$I,OOO, <br />plus applicable state, and/or local sales tax, (now 6%). $1,060 due upon execution of <br />this lease, for the first month's rent, and N/A for the last month's rent, said monthly <br />rental being payable in advance. Said monthly rental shall commence of the first day <br />of the term of this lease as described in the preceding section with rent to be pro- <br />rated to the first of the month. Applicable state sales tax to be added to the base rental <br />amounts. Rent to be due and payable on the first day of each month. Any payments not <br />received by the fifth day of the month wiD accrue a penalty of 5% as liquidated <br />damages to cover the Landlord's additional charges. This will be added to the <br />rental amount due. Tenant agrees to pay this penalty if rented amounts are not <br />paid timely as per lease t~rms. <br /> <br />4. SECURITY DEPOSIT: On execution of this Agreement, Tenant has <br />deposited with the Landlord $1,000, receipt of which is hereby acknowledged by the <br />Landlord, as security for the faithful performance by the Tenant of the terms hereof. <br />Landlord shall hold said deposit without liability for interest.
