Payment to or for the account of the grantors or mortgagors of the full consideration for the <br />estate or interest to be insured. <br /> <br />2. Proper instrument(s) creating the estate or interest to be insured must be approved, executed <br />and filed for record: <br /> <br />(a) Partial Tennination of that certain Notice of Commencement recorded in Official <br />Records Book 5780, Page 1686, public records Pasco County, Florida releasing <br />.subject property by furnishing the following: <br />(i) Executed Contractor's Final Affidavit and Release of Lien; <br />(ii) Release of lien from each person shown as baving given notice to Lowe's <br />Home Center, Inc. ("Lowe's) in the Construction Lien Affidavit; <br />(ili) Release of lien from each person shown as having a direct contract with <br />Lowe's in the Construction Lien Affidavit; <br />(iv) Final Waiver of Lien from each person shown as unpaid in Contractor's Final <br />Affidavit and Release of Lien; <br />(v) Record Notice of Termination and Cancellation of Notice of <br />Commencement; <br />(vi) Indemnity, satisfactory to the Company, executed by Lowe's, and any other <br />party requested by the Company, must be furnished, together with financial <br />infoIDlation from all indemnitors, which financial infonnation must be <br />deemed by the Company to establish that the Indemnity represents security <br />commensurate with such risk. <br /> <br />(b) Special Warranty Deed from Oakley Groves, Inc., a Florida corporation to RT <br />Tampa Franchise, L.P., a Delaware limited partnership. <br /> <br />3. Satisfactory proof must be furnished establishing that Oakley Groves, Inc., a Florida <br />corporation is a corporation duly organized, validly existing, and in good standing lmderthe <br />la wS of the State of Florida. <br /> <br />4. Corporate Resolution from the Board of Directors of Oakley Groves, Inc., a Florida <br />corporation authorizing the sale of subject property and specifying the officers who are <br />authorized to executed the Special Warranty Deed. <br />
