<br />Contractor shall have the right to rely n Owner's representation with respect ormation provided by the individual(s) executing this document concerning, among other things, the ownership
<br />of the property, authorization to perform the work as contracted herein, and any other facts or data relating to the project and the property itself. Failure by the owner to provide accurate and
<br />complete in(ormation requested by Contractor shall be a material breach of this contract. '
<br />The Owner shall be the sole entity responsible for securing all required authorization in order to permit Contractor access to the property, and in order to provide sufficient access to the property
<br />with any and all equipment and materials, Owner shall be responsible for protecting andlor removing any trees, bushes, sod, walls, fences, sprinklers, septic tanks, water or sewer lines, driveways.
<br />and sidewalks, or any other obstruction which is required for the performance of this contract. In the event that Owner fails to secure or provide access as required, the Owner shall be responsible
<br />for any replacement costs or other damage caused as a result of Owner's failure to provide such reasonable and proper access. Contractor shall not be responsible for any damege caused to
<br />any property as a resull of Owner's failure to provide adequate and proper access to the work site. The Owner shall be responsible to advise Contractor of any condition or circumstances, which
<br />will prevent or hinder Contractor (rom accessing the property or a condition which could pose a threatto'flroperty or persons.
<br />Owner shall be the sole entity responsible for complying with Florida State Statutes andlor any applicable law requiring' proper pool barriers, door alarms, fences and/or screen enclosures, Owner
<br />shall not use the pool until such time that all applicable law requirements with respect to fencing or enclosures is in place, inspected and approved by the appropriate governing authorities, Use
<br />of the pool by anyone prior to final completion by Contractor shall constitute Owner's unconditional acceptance of the pool and all related equipmerd and materials, and shall immediately thereupon
<br />bring about the Owner's obligation to'make payment in full pursuant to the contract sum. In the event that an inspection is rejected due to the failure to provide proper barrier protection as required
<br />by Florida law, Owner shall be obligated to pay Contractor any additional fees, fines, or expenses associated with the reinsertion of the property by building officials or those having jurisdictional
<br />responsibility over the project
<br />Owner shall have the right to cancel this contract, but only within three days from the date of its execution by Owner. Such cancellation must be in writing and submitted to Contractor by the
<br />close of business on the third day (rom the date of the execution hereof.
<br />Contractor shall endeavor to complete the placement of the pool shell within five working days of, the completion of its excavation activities. Contractor shall endeavor to complete all concrete
<br />work associated with the pool's shell within 15 working days from the completion of all excavation activities. The time necessary to complete the foregoing items shall be adjusted for any delays
<br />which are not within the control of Contractor, and which involve, but are not limited to, concrete shortages, personnel shortage, delays in delivery, inclement weather, changes In applicable law,
<br />failed inspections, or any changes made to the terms and conditions of this contract,
<br />The work of this contract shall be deemed substantially completed upon the completion of the concrete decking. Owner agrees that all pool dimensions as noted herein above, or in any other
<br />drawmg submitted to the Owner, are approximations, which shall vary. Owner understands that any changes to the terms and conditions of this contract, andlor any changes to the specifications
<br />and locations relating to the pool shall be reviewed and the contract amount and contract lime shall be equi/8bly adjusted thereupon. Contractor shall not be obligated to perform any changes,
<br />other than those expressly provided (or herein. Any additional costs involving a chllnge order or a modification to this contract must be paid in full at the time that such change is agreed to by
<br />the parties. Contractor shall not be responsible to perform any change work until such time that the Owner has paid for the costs of such change work and has agreed in writinQ to the nature
<br />o( such change,
<br />OWNER IS RESPONSIBLE FOR READING ALL CONDITIONS OF CONTRACT AS CONTAINED ON THE REVERSE SIDE OF THIS CUSTOMER CONTRACT. IF, FOR WHATEVER REASON, \
<br />OWNER DOES NOT RECEIVE A COpy OF THIS CONTRACT CONTAINING SAID CONDITIONS OF CONTRACT,IT SHALL BE THE OWER'S RESPONSIBIUry TO ADVISE CONTRACTOR
<br />ACCORDINGLY AND REQUEST A COpy THEREOF. IN ADDITION, OWNER SHALL BE RESPONSIBLE TO OBTAIN FROM CONTRACTOR ALL MANUALS IN CONNECTION WITH THE
<br />REQUIRED PROPER CARE AND OPERATION OF THE POOL AND RELATED ACCESSORIES. AS A CONDITION TO SIGNING THIS AG EMENT, OWNER REPRESENTS THAT HE/SHE
<br />HAS READ SUCH MANUALS AND AGREES TO FOLLOW AND UNDERSTANDS THE GUIDEUNES FOR MAINTENANCE OUTUN Y TH ANUFACTURERS OF THE POOL SHELL.
