<br />PHOENIX FIBERGlASS POOLS, INC. (hereinafter referred to as 'Contractor") shall have the un~nditional right. to rely on infonnation provided by the
<br />individual(s) executing this contract concerning, among other things, the ownership of the property, authorization to perfonn the work as contracted herein, and any
<br />other facts or data relating to~ Contractor's work and the real property itself. Failure by the Owner, or its agents, to timely provide accurate and complete
<br />infonnation shall be a material breach of this contract.
<br />
<br />The Owner shall be the sole entity responsible for providing Contractor, including its equipment and materials, sufficient access to the property. Owner shall
<br />protect and/or remove any trees, bushes, sod, wal~, fences, sprinklers, septic tanks, underground utilities, driveways and sidewalks, or any other obstruction
<br />hindering Contractor from perfonning its work. In the event that Owner fails to timely secure or provide access as required, the Owner shall ~ responsible for any
<br />replacement and/or remobilization costs, or any other damages caused as a result thereof. Contractor shall not be responsible for any damage caused to any
<br />property as a result of Owner's failure to timely provide adequate and proper access to the work site. The Owner shall advise Contractor of any condition or
<br />circumstances which will prevent or hinder Cqiltractor from accessing the property, or any condition which could pose a threat to property or persons.
<br />
<br />Owner shall be the sole entity responsible ,for complying with any applicable child barrier protection laws. Owner shall not use the pool until such time that all
<br />applicable child barrier protection devices are in place, inspected and approved by the appropriate governing authorities. Use of the pool by anyone prior to final
<br />completion by Contractor shall constitute .Owner's unconditional acceptance of the pool and all related equipment and materials; and shall immediately thereupon
<br />bring about the Owner's obligation to make payment in full. In the event that an inspection is rejected due to Owner's failure to provide proper barrier protection as
<br />required by Florida law, Owner shall be obligated to pay Contractor any additional fees, fines, or expenses associated with the re-inspection of the property by
<br />building officials or those having jurisdictional responsibility over the project.
<br />
<br />Owner shall have the right to cancel this contract, but only within three days from the date of its execution by Owner. Such cancellation must be in writing and
<br />received by the 'Contractor by no later than close of business on the third day from the date of the execution hereof.
<br />
<br />The time necessary to complete the work of this contract shall be adjusted for any delays which are not within the control of Contractor. The Contractor shall be
<br />granted additional time to complete its work in the event delays are caused by, but are not limited to, obtaining necessary building pennits, unacceptable soil
<br />conditions, lack of sufficient and proper access, concrete shortages, personnel shortage, delays in delivery, inclement weather, changes in applicable law, failed
<br />inspections, or any changes made to the tenns and conditions of this contract.
<br />
<br />The work of this contract shall be deemed substantially complete upon the completion of the cona-ete decking, or final acceptance by the building authority,
<br />whichever occurs first. Owner agrees that all pool dimensions as noted herein above, or in any other drawing or literature prepared on Contractors' behalf are
<br />approximations, and therefore, shall vary. Owner understands that any changes to the tenns and conditions of this contract, and/or any changes to the pool
<br />location or placement shall result in an equitable adjustment of the contract amount and contract time. Contractor shall not be obligated to perfonn any changes
<br />other than those expressly provided for herein. Any additional costs involving a change order or a modification to this contract must be paid in full at the time that
<br />such change is agreed to in writing by the parties. Contractor shall not be responsible or required to perfonn any change work unless and until such time that the
<br />Owner has paid for the costs of such change work and has agreed in writing to the nature of such change.

<br />OWNER IS RESPONSIBLE FOR READING ALL CONDtnONS OF THIS CONTRACT, AS CONTAINED ON THE REVERSE SIDE HEREOF; AND All
<br />REQUIRED NOTICES ATTACHED HEREWITH. IF, FOR WHATEVER REASON, OWNER DOES NOT RECEIVE A COPY OF THIS CONTRACT CONTAINING
<br />SAID CONDITIONS OF CONTRACT, OR THE REQUIRED NOTICES, IT SHALL BE THE OWNER'S RESPONSIBIUTY TO ADVISE CONTRACTOR
<br />ACCORDINGLY AND REQUEST IN WRITING A COpy THEREOF. IN ADDITION, OWNER SHALL BE RESPONSIBLE TO OBTAIN FROM CONTRACTOR
<br />ALL MANUALS IN CONNECTION WITH THE REQUIRED PROPER CARE AND OPERATION OF THE POOL AND RELATED ACCESSORIES. AS A
<br />CONDtnON TO SIGNING THIS AGREEMENT, OWNER REPRESENTS THAT HE/SHE HAS READ SUCH MANUALS AND AGREES TO FOLLOW SAME
<br />AND UNDERSTANDS THE GUIDELINES FOR MAINTENANCE OUTLINED BY THE MANUFACTURERS OF THE POOL SHELL, FILTRATION EQUIPMENT,
