<br />REGULAR COUN.~IL MEETING <br /> <br />A Regular Council Meeting was held on August 14, 2006 at 6:00 p.m. in the Robert H. <br />Johnson Council Chambers of the Municipal Building. <br />President Bracknell called the meeting to order. Roll call was taken. Present were <br />members Clyde Bracknell, Daniel Burgess, Kenneth Compton, Celia Graham, and Luis Lopez, <br />Mayor Cliff McDuffie was absent. City Manager Steve Spina and City Attorney Joseph Poblick <br />were also present. <br />Staff present: Police Captain Randy Belasic, Acting Fire Chief Kerry Barnett, Utilities <br />Superintendent Loute Sellars~ Public Works Director Rick Moore, Building Official Bill <br />Burgess, Director of Administrative Services Sharry Boldt, Finance Director Cathy Familo, <br />Director of Development Todd Vande Berg, Librarian Kathleen Burnside and City Clerk Linda <br />Boan. <br />Rev, David Fritz from the Church of the Living Word gave the Invocation. The Pledge <br />of Allegiance followed. Daniel Burgess moved the minutes of the July 24, 2006 Regular <br />Meeting, July 24,2006 Workshop, July 31, 2006 Workshop and August 7, 2006 Workshop be <br />approved. Seconded tiy Celia Graham. Motion passed unanimously. <br /> <br />PUBLIC HEARING <br /> <br />1. Conditional Use for Duplex on 6th Street <br /> <br />A public hearing was held for the conditional use for a duplex on two vacant lots at 5031 <br />6th Street. Mr, Vande Berg said the conditional use request was denied by the Planning <br />Commission and approved by the Site Plan Review Committee. <br />The following persons spoke from the floor: Chairperson of the Planning Commission <br />Jodi Wilkeson, 5816 t'8th Street; Vice Chairperson of the Planning Commission William Back, <br />39105 Cardinal Avenue were concerned because the Planning Commission unanimously <br />recommended denial of the conditional use request and the precedent and ramifications if <br />Council were to choose to approve this. Toni Schmidt, 14433 Nottingham Trail, Hudson, said <br />the property is too small to meet the parking requirements for an office/professional business on <br />the site and she requested the Council approval of the conditional use. <br />Luis Lopez moved the motion made at the last meeting to approve the conditional use <br />request be rescinded. Second~d by Kenneth Compton. Motion passed unanimously. <br />Luis Lopez moved the conditional use petition be approved with the corrections and <br />including the two conditions, Seconded by Kenneth Compton, Motion passed unanimously. <br /> <br />2, Gore Dairy Developer's Agreement <br /> <br />Mr. Vande Berg provided a revised developer's agreement for the commercial section of <br />the Gore Dairy property and said staff and the City Attorney recommended approval. This is the <br />first of two public hearings. Those speaking from the floor were: Traffic Consultant for the <br />City, David Trommell, with Kimley Horn and Associates; attorney for the developer, Clarke <br />Hobby, 109 N. Brush Street, Tampa. <br />Kenneth COlll-pton moved the recommendation of staff be accepted for the Gore Dairy <br />developer's agreement. Seconded by Celia Graham. Motion passed unanimously. <br /> <br />V ANnE BERG <br /> <br />3. Report from Planning Commission - Acme Development Rezoning <br /> <br />Mr. Vande Berg said a rezoning petition was submitted by Acme Development Corp. for <br />approximately 27.52 vacant acres located on the west side of Fort King Road north of Eiland <br />Blvd. Staffand Site Plan Review Committee recommended approval of the rezoning petition <br />with the following conditions: <br /> <br />~ The developer/applicant acknowledges that any provisions of the City of Zephyrhills <br />ordinances \llld rezoning conditions of approval not specifically waived shall be in full <br />force and effect, including all impact fees, drainage and landscaping ordinances. <br />
