<br />CONTRACT <br /> <br />AGREEMENT made this I day of MI/-Lf .2007. by and between LANIER <br />FENCE INC. hereinatler referred to as "LFI" and, hereinafter referred to as Customer." <br />In consideration of the mutual covenants contained herein and the consideration. to be paid by Customer to <br />Lanier Fence Inc.. it is agreed as follows: <br />1. Customer shall pay to LFI the sum of$ ~f?6 9. 6~ for the work described herein. <br />Payment shall be made to LFI by the Customer upon. completion, unless otherwise specified. <br />2. LFI agrees to furnish all necessm:y labor and materials to construct the improvements described herein as <br />per the specifications and drawings. if any. shown on 1he reverse side. LFI further warrants all materials will be as <br />specified and that all work will be completed in a workmanlike manner acc:ording to standard practices. <br />3. If this is a residential job. Customer represents and warrants that he is 1he owner of the property descnDed <br />herein. If this is a commercial job. Customer lcp~ that be is 1he owner of the property descnDed herein. or a <br />contractor who bas a contract to improve property owned by tJ-Ire,f-., . <br />and that part of the improvements contracted for by the owner include worlc descnDed herem. <br />4. ~ agrees to locate, relocate. ~ and clear fence lines. and assumes full responsibiIity for same. <br />Customer agrees to indemnify and bold LFI baimlei;S for any liabiIity or damages that may result fi:om Customer's <br />failure to properly locate. stake and clear fence lines. Customer further agrees to advise LFI of any deed..~ or <br />other restrictions. which may affect construction. of the fence or other improvements to be <br />consIructed by LFJ.and agrees to jn(JenmifY and bold LFI harmless ftom any liabiIity or damages that may result <br />'bec8Use o(ihe fit.ilun,to' eomply Wi1h deed,'Subdivision. or other restrictions.. ' <br />5. LFI does not 8ssume any responsibility or liability for any damage of any:nature to underground <br />obstructions. Customer agrees to clearly made and advise LFI of any underground obstmctions in the area of the fence ' <br />line or: the improvements to be constructed by LFI. Customer assumes responsibility for any ~ to underground <br />obstructions caused by Custome.r's failure to mark or advise LFI of their existence. F9I' purposes oftbis.Aweement. <br />undeJground obstructiQDSinclude but are not limited to all improvements constructed underground including utility <br />pipeS, Cables, foundations, and the like. <br />,,(i 'It is agreed by and between the parties. that any alteration or deviation ftom the above specifications <br />involving extnl cost is to be performed by ,LFI and will become an extra charge over and above 1he price stated herein. <br />7. Customer agrees to pay in full the price stated herein upon. completion. of work.. Any failure to pay within <br />three (3) days after completion ofworlc, excluding Sundays or Holidays shall be considered a defiwlt and LFIshall be <br />,. entitled to recover the full8lJlO1Jlii ofthe~lceplus in1erest (finance charge) at 1he rate of 1 IJ'201O per month (18% per <br />annmn) until the contract price is paid in full. In the event it becomes necessary for LFI to take collection action, <br />Customer ~to pay all costs Of coJIectieDs including reasonable attomey's tees and costs. <br />8. It is agreed between the parties that LFI will keep $275.00 ftom. deposit if said contract is cimceled by <br />customer. <br />9. It is further agreed between the parties that 1he fencing materials shall remain personal ptoperty until1he <br />contract price is paid in full. In the event the Customer tails to pay the contract price. LFI shall have the right to <br />peaceably repossess and remove all materials insIalled by it on. the premises. Customer further agrees that LFI shall <br />have all of the rights of a-secured party. as the same is defined under the Florida Uniform. Commercial Code. and that <br />said rights shall be cumulative and in addition to any other rights which LFI may have in accordance with Florida Law. <br />10. If Visa or Master Cards are used ~ pay ~ or any amount toward ~ the amount cbarged through <br />terminal will be assessed an extra 4% for tenninaI. fees. Credit card cbedcs will not be assessed the extnl4%. <br />.11. LFI is not responsible for warping or cracking ofwood products. <br />'12. LFI will W8I'I'8II1}' labor for indal1ation, (residentiaI,only) for a period of! year. <br />13. LFI will w6u.4y labor for ~Us.tion. (residentia1Icommercial gate operator) for a period of90 days. <br />14. This agreement is the entire agreement of the parties and cannot be Changed except in writing signed by <br />both ~ 1here are no wananties or IgpI""""bdions except as are expressed herein. LFI specific:ally disclaims all <br />EXPRESS and IMPLIED WARRANTIES, including any WARRANTY OF MERCHANT ABILITY or FITNESS <br />FOR.
