<br />BOARD OF ADJUSTMENT <br /> <br />The Board of Adjustment meeting was held on Tuesday, November 14, 2006, at <br />4:0 p.m. in the Robert H. Johnson Council Chambers of City Hall. Roll <br />cal was taken. Present were members Wallace Reeves, Gary Hatrick, Pat <br />Bes'gner and William Poe, Sr. Staff present: City Attorney Joe Poblick, <br />Cit Building Official Bill Burgess, City Manager Steve Spina and Senior <br />Cod Support Specialist Bobbie Swetland. <br /> <br /> <br />Pledge of Allegiance followed. Motion was made by Pat Besinger to <br />ove minutes of meeting of October 10, 2006. Seconded by Gary Hartick <br />passed unanimously. <br /> <br />Francis Panzer, property owner, 4944 18th Street, variance request of <br />foot on side boundary setback to construct an addition. Mr. Panzer <br />essed the board regarding his request stating that he wanted to <br />ding a screen room & carport and desired to keep them in alignment with <br />existing home. City attorney Joe Poblick had no legal objection. <br />ding Official Bill Burgess stated he saw no problem in approving the <br />est as long as there was continuance footprint of existing house. After <br />f discussion, motion was made by Gary Hatrick to approve the request. <br />ded by Pat Besinger and motion passed unanimously. <br /> <br />(2) James H. Caldwell, property owner, 3524 Pyrite Drive, Emerald Pointe, <br />variance request for rear setback of four feet to accommodate motor home. <br />Anya Kudszus addressed the board stating she was attorney representing the <br />Cal ells. Ms. Kudszus began by saying that the Caldwells wanted to build <br />thei dream home & in order to do that they needed to build a motor home <br />gara e that would be big enough to fully enclose their motor home & they <br />nee d to extend the motor home garage past the five foot setback - three <br />foot into the setback. At this time she asked the original request of four <br />feet be changed to three feet. <br /> <br /> <br />Burgess stated his concern was the request didn't meet the true <br />ition of a hardship. Attorney Kudszus replied that the hardship is <br />the Caldwells motor home is 45 feet long & in order to totally enclose <br />not have it sticking several feet out in the front of their house, <br />would be an eyesore, they needed to extend their garage a few feet <br />so motor home could fit all the way inside & if variance is not <br />ed, the sun would be beating down on it & with them living there full <br />this would be a hardship. Also there is an issue of safety & having <br />en & not knowing what could get inside was a concern. <br /> <br />member Gary Hatrick asked how long the Caldwells had owned the <br />rty & they answered since January. He also asked if they owned the <br />moto home before they purchased the property. The Caldwells answered yes. <br />Hatr'ck then stated that according to board of adjustment rules you can't <br />crea e your own hardship & if motor home was purchased before they brought <br />the roperty he didn't consider this a hardship per the board's rules. <br />Atto ney Kudszus stated she didn't believe the Caldwells did this <br />inte tionally. <br />
