<br />ATTACHMENT <br /> <br />Bid/Contract Documents <br />(Plans, timelines, cost breakdowns and specifications included in bid packages to become part of the <br />Agreement) <br /> <br />17.3 Assignment. The Agreement may not be assigned by Contractor, either voluntarily, <br />involuntarily or by operation of law, and any such assignment, or purported assignment, will be a <br />material breach of the Agreement. <br />17.4 Amendments. The Agreement and General Conditions will not be modified, altered, <br />amended or revoked except in writing duly executed by an authorized representative of Contractor and a <br />vice president of Owner. <br />17.5 Waiver Or Delay. Any waiver of any provision of the Agreement, or a delay by either <br />party in the enforcement of any right hereunder, shall neither be construed as a continuing waiver nor <br />create an expectation of non-enforcement of that or any other provision or right. No term or provision <br />shall be deemed waived and no breach excused unless such waiver or consent shall be in writing and <br />signed by the party claimed to have waived or consented. <br />17.6 Severability. If any provision of the Agreement or General Conditions shall be held <br />illegal, unenforceable, or in conflict with any law of a federal, state, or local government having <br />jurisdiction, the validity of the remaining portions or provisions hereof shall not be affected thereby. <br />17.7 Cumulative Remedies. All remedies available to either party for breach of the <br />Agreement are cumulative and may be exercised concurrently or separately, and the exercise of anyone <br />remedy shall not be deemed an election of such remedy to the exclusion of other remedies. <br />17.8 Entire Agreement.
