E-mail: provides as follows: <br /> <br />License # CBC1250914 <br />CONSTRUCTION AGREEMENT <br /> <br />1. CONSTRUCTION: The Contractor agrees, for the consideration, hereinafter <br />mentioned, to furnish and deliver to the Owner, "Interior Remodel, Firewall, Fire Door and <br />Storage Area brought up to code" as per plans, signed and dated by Owner, to be furnished <br />by Owner and thus becomes part of this contract. <br /> <br />2. PuRCHASE PRICE: In consideration thereof, the Owner shall payor cause to be <br />paid to the Contractor; cost plus a sum of twelve percent (12%) of the total cost of all <br />materials, labor, supplies, supervision, permitting, overhead, etc. Payment shall be due on <br />the 15th and 30th of each month with a deposit of $3.000.00 that shall be paid to Contractor <br />upon execution of this Agreement. <br /> <br />3. SELECfION OF MATERIALS: Owner agrees to complete all selections of materials <br />that's the responsibility of the Owner, within five l1J days of request, time being of the <br />essence. All selections must be in conformity with the contract, plans, and specifications. <br />In the event the Owner fails to make appropriate selections within time requested, the <br />Contractor, at its option, may make appropriate selections on behalf of the Owner in order <br />to avoid any delays in construction and any additional costs associated therewith. The <br />Contractor's selection shall be binding upon the Owner. <br /> <br />4. SUBSTITUTIONS: Owner agrees that Contractor shall have the right to <br />substitutions and give advance notice whenever possible. <br /> <br />5. TIME AND MANNER OF PERFORMANCE BY CONTRACOR. Contractor shall <br />commence COnstruction of improvements within five (5) business days of the issuance of <br />all building permits and verification from Buyer in writing that all funds necessary for <br />payment of the T ota! Contract Price are available, whichever shall last occur: Contractor <br />shall diligently pursue and substantially complete all work to be performed under this <br />Contract within ~ days from start of construction. Start of construction is defined as <br />the date on which footings are poured, taking into consideration delays that are beyond the <br />control of the Contractor, including, but not limited to, weather conditions, delays in <br />selection or delivery of materials, change orders requested by Buyer and delays in <br />obtaining all necessary licenses or permits or the certificate of occupancy. Contractor shall <br />not be liable to Owner for any losses, costs, inconveniences or consequential damages <br />resulting from or arising out of a delay or inability to perfonn this Contract as described <br />herein or caused by any event beyond the control of the contractor.
