<br />SECTION NINE <br />UTILITIES <br /> <br />Lessee shall arrange and pay for all utilities furnished to the demised premises for the <br />term of this lease/option to purchase agreement, including, but not limited to, electricity, <br />gas, water, sewer, and telephone service. <br /> <br />SECTION TEN <br />REPAIRS AND MAINTENANCE <br /> <br />Lessee shall maintain the demised premises and keep them in good repair at its <br />expense. Lessor shall assist Lessee in procuring permits for renovations, costs of <br />procurement of permits to be borne by Lessee. <br /> <br />SECTION ELEVEN <br />DELIVERY, ACCEPTANCE, AND SURRENDER OF PREMISES <br /> <br />A.. Prior to entering into this contract and acceptance of the premises, the premises <br />shall be inspected by the County and/or City Building Department and Fire Marshal. In <br />the event either or both departments or other government entity with such powers render <br />the demised premises unfit for use by the Lessee for conducting business as the Lessee <br />intends to use the premises for, or either or both departments or other government entity <br />requires repairs, additions or deletions from the existing property, the Lessee will not <br />accept the property, will not enter into this contract and all other verbal negotiations <br />related hereto shall be rendered null and void. <br /> <br />B. In the event the Lessee does not exercise its option to purchase, Lessee shall <br />surrender the demised premises at the end of the lease term, or any renewal of such term, <br />in the same condition as when Lessee took possession, allowing for improvements and <br />reasonable use and wear, and damage by acts of God, including fires and storms. Before <br />delivery, Lessee shall remove all business signs placed on the demised premises by <br />Lessee and restore the portion of the demised premises on which they were placed in the <br />same condition as when received. In the event the Lessee does not exercise its op;tion to <br />purchase, the lease payments and $10,000 down payment is not refundable to the Lessee. <br /> <br />SECTION TWEL VB <br /> <br />ENTRY ON PREMISES BY LESSOR <br /> <br />A. Lessor reserves the right to enter on the demised premises during business hours, at <br />reasonable times; however, Lessor shall not interfere with Lessee's ability to conduct <br />business. <br /> <br />B. Lessee may erect scaffolding, fences, and similar structures, post relevant notices, <br />and place moveable equipment in connection with making alterations, additions, or <br /> <br />Page 4 of 10 <br /> <br />- <br /> <br />I <br />I <br />i <br />
