:ZEPHYRHILLS INTEROFFICE MEMORANDUM
TO: Bill Burgess, Building Official DATE: November 23, 2004
FROM: Kar1a.S. Owens
-City. Attorney
RE: Legal Opinion/LightedNon- moving Sign
T Oi Z E'PIIYi Iii I. / i - r4
You have requested .a legal opinion regarding whether a lighted, but non- moving reader board
sign is permitted under the City's new sign ordinance. The new ordinance specifically prohibits
activated signs. Basically, this definition includes signs which contains lights which change
color, flash or move. It is my understanding that the individual you spoke with would like to
erect a changeable copy sign on commercial property, which, although technically capable of
motion, will not be activated. As you know, the ordinance does permit both lighted and
changeable copy signs so long as there is no activation, movement, or flashing of the copy or the
sign itself. Consequently, it is my opinion that a lighted changeable copy /reader board sign may
be permitted and erected so long as the copy is not activated. .I would -recommend that you
provide a written condition on the permit to this effect.
1
