connived, or agreed, directly or indirectly with any other Bidder, firm, or person to submit a collusive or shall
<br /> Bid in connection with the Contractor for which the attached Bid has been submitted or to refrain from bidding
<br /> in connection with such contract, or has in any manner, directly or indirectly, sought by agreement or collusion
<br /> or communication or conference with any other Bidder, firm, or person to fix any overhead, profit, or cost
<br /> element of the Bid price or the Bid price of any other Bidder, or to secure through any collusion, conspiracy,
<br /> connivance, or unlawful agreement, any advantage against the Pasco County Community Development
<br /> Division, or any person interested in the proposed contract; and,
<br /> The price or prices quoted are fair and proper and are not tainted by any collusion, conspiracy,
<br /> connivance, or unlawful agreement on the part of the Bidder or any of its agents, representatives, owners,
<br /> employees, or parties in interest, including this affiant.
<br /> ARTICLE 19. - INTEREST OF MEMBERS, OFFICERS, EMPLOYEES OF PUBLIC BODY MEMBERS
<br /> OF LOCAL GOVERNING BODY, OR OTHER PUBLIC OFFICIALS: No member, officer, or employee of
<br /> Pasco County, or its designees or agents, no member of the governing body of the locality in which the
<br /> program is situated, and no other public official of such locality or localities who exercises any functions or
<br /> responsibilities with respect to the program during his tenure or for one (1) year thereafter, shall have any
<br /> interest, direct or indirect, in any contractor subcontract, or the proceeds thereof, for work to be performed in
<br /> connection with the program assisted under the Agreement.
<br /> ARTICLE 20. - PROHIBITION OF BONUS OR COMMISSION: The assistance provided under this
<br /> Agreement shall not be used in payment of any bonus or commission for the purpose of obtaining County
<br /> approval of the application for such assistance.
<br /> ARTICLE 21. - LOCAL EMPLOYMENT: To the greatest extent possible, the Contractor agrees to hire,
<br /> train, and subcontract to individuals and firms that live or are located in Pasco County and the Tampa Bay
<br /> Area.
<br /> ARTICLE 22. - MINORITY AND WOMEN BUSINESS ENTERPRISE: To the greatest extent possible,
<br /> the Contractor agrees that he will, if it is necessary, subcontract work to minority- and women -owned
<br /> businesses.
<br /> ARTICLE 23. — SECTION 3: HUD ACT OF 1968: The Section 3 preference requirement applies to any
<br /> contract in excess of $100,000.00.. The purpose of Section 3 is to ensure that employment opportunities
<br /> generated by HUD financial assistance, shall to the greatest extent feasible, be directed to low- and very low -
<br /> income persons, particularly those who are recipients of government assistance for housing and to business
<br /> concerns that provide economic opportunities to low- and very low- income persons. If this contract is in
<br /> excess of $100,000.00 the following language is applicable, and shall be included in any subcontracts:
<br /> Section 3 Clause: All section 3 contracts shall include the following clause (referred to as the Section 3
<br /> Clause):
<br /> 23.1 The work to be performed under this contract is subject to the requirements of Section 3 of the
<br /> Housing and Urban Development Act of 1968, as amended, 12 U.S.C. 1701u. Section 3
<br /> requires that, to the greatest extent feasible, opportunities for training and employment be given
<br /> lower- income residents of the project area, and contracts for work in connection with the project
<br /> be awarded to business concerns, which are located in or owned in substantial part by persons
<br /> residing in the area of the project.
<br /> 23.2 The parties to this contract agree to comply with HUD's regulations in 24 Part CFR 135, and all
<br /> applicable rules and orders of the Department issued thereunder prior to the execution of this
<br /> contract. As evidenced by their execution of this contract, the parties to this contract certify that
