<br /> referred to as "BDF" and, hereinafter referred to as "Customer."
<br /> In consideration of the mutual covenants contained herein and the consideration to be paid by Customer to Big Dog Fence
<br /> Inc., it is agreed as follows:
<br /> 1. Customer shall pay #o Big Dog Fence Inc the sum of $ 3I ��ir. SQ for the work described herein. Payment shall be
<br /> maae ta BDF by'�he Cus�oiner upan c�r�letion, imless ol�ervvise specified.
<br /> 2. BDF agrees to furnish a[I nacessary labor and materiaLs to const�u+ct the improvem�nts described
<br /> herein as per the specifications and drawings, if any, shown on the reverse side. BDF further wairanis 81I materials yvili be as
<br /> s�i� az►dt�at all v�ocl�v�Ll i� c+cs$��:�e,cl in avcotl�like �ac�avr a�,c,o�dingto s�d �cs.
<br /> 3. If this is a residential job, Customer represents and warrants that he/she is the owner of the property described herein. If
<br /> this is a commercial job, Cusbnmer represents mat he/she is the owner of the property descn�bed herein, or an Agerrt, Board
<br /> Member, reQresenting CDD/HOA Organization/Company,
<br /> or a coniractor who has a contract to improve property
<br /> owned bY and #hat part of the improvem�ts con�acted for by the
<br /> owner include the work described herein.
<br /> 4. Customer agrees to locate, relocate, stake and clear fence lines, and assumss full responsibility for same. Customer
<br /> agre�.s to indemnify aad hold BDF harmless for any liability or damages that may result from Customer's fa.ilure to properly
<br /> locate, stalce snd clear fe�e lines. Cvsbomer fi�er agre�s to advise BDF of any deed, subdivision, or other restrictions which
<br /> may aifect construction of t�e fence or ofher improvemen#s to be constructed by BDF, and agrees to indemnify and hold BDF
<br /> harmless from any l�ability or damages that may result becaase of the failure to compiy with deed, subdivision, or other
<br /> restrictions.
<br /> 5. BDF will call the k�cal i3tilitjr Locating Service. BDF dces nat a�.s�me anY r�ansibilitY or habilrtY fo�' an3' damage of
<br /> any nature to underground obstructions. Costomer agre�s to clearly "mazk" any underground obstructions� in the area of tl�e
<br /> fence line or the improvemeuts to be consd�ucted by BDF. Cnsbomer assumes responsibility for any damage to undergrowid
<br /> obstructians eaused by Castome�'s failure to laeate aad maric a�ccur utely with paint or flags, their exis�ene,�. For pucgosres of thss
<br /> Agreement, under�round obst�ucdons include birt are not limited to all improvements constcucted undecgmund including utility
<br /> PiF�. SP�� PiP� cables, wires, foundations, and the like.
<br /> 6. lt �s agc�eed by and between the parti�s, t�at any att�ration or deviation from the above specifications involving e�a cost
<br /> is to be performed by BDF and wil2 become an extra charge over and above the price stated herein.
<br /> 7. Customer agrees to pay in fulI the price sta� herein upon completion of work. Any failure to �y within three (3) days
<br /> after completion of work, excluding Sundays and Holidays shall be considered a default and BDF shall be entiUed ta recover
<br /> the fuI� amouut of 8ie im►oiee plus i�erest (finance charge) at the rd#e of 1 1%2% per mo�h (2 8% per annum) uutii the contract
<br /> price is paid in fiill. In �e eveat it becomes necessary for BDF to take collection action, Costomer agcees to pay si1 eosts of
<br /> collections including reasonable attorney's fees and costs.
<br /> 8. It is agreed between line parties tl�t BDF will retain S 125.00 from depos'it if said co�ract is cancelled by customer and
<br /> cust�mer fiuther agrees to a 2S% restockiag fee plus retum 5�eight cost for atl special orders. No retum for ceastom orders.
<br /> 9. It is fiut� agr�eed between the parties ti�at ihe fencing materials shall remain personal Pi'oPenY until the contract price is
<br /> p�►id in fulL In th� evemt ttre Cus�ome�r fails t�i pay the crcx�tra+ct price, BDF s�sall I�ave the right to p�b}y ��
<br /> remove all materials instailed by it on the premises. G�.stomer fiuther agrees that BDF sl�ail have aii of the rights of a secured
<br /> pariy, as the same is defined under the Florida Uniform Commercial Code, and that said rights sha(I be cumutative and in
<br /> addition to any other righfs which BDF inay have in accordance with Florida Law.
<br /> 10. If Credit Cards are used to pay total, or any amourn toward tot�l, the �moimt charged t�roeigh t�eermmai will be assessed
<br /> an extra 3.5% proc�g fee. Credit card checks will not be ass�ssed the e�ctnt 3.5%.
<br /> 11. HDF is not responsi'ble f�r waiping or cracking of wood products.
<br /> 1 Z. BDF will warranty tabor for in.�tallation of residentiaUcommercial for a period of 1 year.
<br /> 13. BDF will wananty )abor for installation, (residential/commercial gate operstor) for period of 90 days.
<br /> 14. This agreemern is the entire agne.emen# of flie parties and cannot be changed excegt in writing signed by both parties.
<br /> Thene ae+e no warranties or �r�ons exce�rt as are expressed henein. BDF specifically disclaims all E;��ESS and
<br /> A�LIID WA�t1RAIVT�S, including any WARRANT7� OF MERCHANT ABII,TTy or FITNESS FOR A PARTICULA.R
