33.Subcontractor shall make all alterations,furnish the materials for and perfortn all extra work or omit any work Contractor,or Architect,may
<br /> require without modifying this Agreement,at a reasonable addition to or reduction from the Subcontract price herein namerl and prorated to the same.
<br /> Subcontractor shall not perform any work nor invoice the Contractor for any work beyond this contract unless the same is ordered in writing,and
<br /> signed by the Contractor.
<br /> 4. Subcontractor shall give his personal superintendence,or have a competent and qualified superintendent,satisfactory to Contractor,authorized to
<br /> supervise the Subcontractor's work at all times.Subcontractor's work is required by Contractor,Subcontractor shall maintain the construction
<br /> schedule as established by Contractor,and shall employ competent,qualified,and licensed,if required,tradesmen in order to perform the work
<br /> required herein in accordance with the construction schedule.Subcontractor shall perform all of the work in a first-class workmanlike mann�er,as
<br /> called for by the contract documents.Should job conditions be such that the Subcontractor cannot perform and complete the work in a first-class,
<br /> workmanlike manner,It shall notify the Contractor prior to proceeding with any of the work.
<br /> 5 (a)Subcontractor shall meet any performance schedules established from time to time by the Contractor.Any such time schedules
<br /> established shall become part of this Agreement.
<br /> (b)Subcontractor agrees to commence his work as directed by Contractor and to diligently and continuously prosecute his work and to
<br /> coordinate his work with other work on project by other trades so that Owner and Contractor shall not be delayed by Subcontractor in completion of
<br /> the project.
<br /> 6.Contractor shall not be liable to Subcontractor for in neased�k��°mm�ned acti�t►of th workme ortother Subcontractors orcothers,a ts of
<br /> pwner,Architect or Engqckacr,or fire or other casualry,
<br /> God,or any other cause beyond Contractor's control,or any circumstance caused or contributed to by Subcontractor.
<br /> 7.Time is of the essence of this Agreement and any breach of same shall go to the essence thereo£Subcontractor in agreeing to complete the work
<br /> diligently,expeditiously,and in a continuous manner as directed by Contractor,has taken into consideration and made allowances for all hindrances
<br /> and delays incident to his work.Ali increased costs,expenses,compensation or damages that Subcontractor may incur by reason of delay caused by
<br /> Contractor are hereby waived.
<br /> g. (a)All work under this subcontract shall conform to all applicable codes.Wherever the specifications or drawings conflict with the code,
<br /> the code will take precedence at no extra cost.Should there be any work stoppage or slowdown caused by a strike,picketing,boycott,or any other
<br /> voluntary or involuntary cessation of work by the Subcontractor,or the Subcontractor's supplier or supPliers,or any of them for any reason,and
<br /> which,in the judgment of the Contractor is causing or is likely to cause an unreasonable delay in the progress of the work to be done by the
<br /> Subcontractor,the Contractor shall have the right to declare this Agreement in default in accordance with Paragraph 10 of this Agreement.
<br /> (b)The Subcontractor agrees to comply with all Municipal,State and Federal codes,laws and ordinances,rules and regulations,Laws shall
<br /> include Federal and State Taac laws,Social Security,Workmen's Compensation,Unempioyment Act,OSHA,the Condominium Act,it applicable,
<br /> and Licensing Laws.Compliance shall include payment of requisite fees.If any act or failure to act by the Subcontractor results in the assessment of
<br /> a civil penalty or liquidated damages,against Contractor,Subcontractor shall reimburse Contractor the amount paid by Contractor,on demand. If,in

<br /> (c)Subcontractor agrees to pay,or to transfer to bond,the liens of any of its Subcontractors or material suppliers to it,or them,within five
<br /> days of notice.Subcontractor recognizes that it has lien rights pursuant to 1713.,et seq.,Fla.Stat.,for failure of payment for its work,materials,and
<br /> services.The Subcontractor agrees to reimburse the Contractor and Owner for all expenses,including legal fees and disbursements,to w�ich the
<br /> Contractor may be put because of any litigation,arbitcation,or any claim made as a result of a breach of this Agreement by Subcontractor or for
<br /> enforcement of the provisions of this Agreement.
