<br /> hereafter referred to as"LSCI, INC.",to furnish,deliver and arrange for installation of all materials necessary to improve the

<br /> Please Note:Equipment/Products must be installed to perform properly by code and within limitations of building structure.
<br /> Under NO circumstances will product engineering,site specific specifications,warranty requirements,Building Department
<br /> requirements,installation requirements,manufactures test and recommendations of application/installation be altered.
<br /> Property owners/purchasers shall not have the authority to alter,change,release liability from the above requirements for any
<br /> reason.Should any third party other than LSCI licensed,certified or trained technicians alter,change,relocate,damage
<br /> equipment or portions of LSCI installed equipment and system,all warranties are null and void and the property owner bears all
<br /> responsibility and liability and releases all vendors,suppliers,manufactures,engineers,test facilities and LSCI from such
<br /> liabilities.Verbal understandings and agreements with LSCI�epresentatives are not binding on LSCI.Any understanding not set
<br /> forth in this agreement is not binding on LSCI or any LSCI contemporary companies.
<br /> 1) This Agreement is not binding on LSCI unless accepted by an officer of LSCI.
<br /> 2) This Agreement is not assignable by the purchaser,but shall be binding on the heirs,assignees,successors and administrators of the estate of Purchasers.
<br /> 3) Purchaser shall pay to LSCI on demand a late fee equal to 5°�of any installment due under this Agreement that is more than 10 days delinquent should purchaser
<br /> purposely and without cause delay said project.Returned checks shall carry an additional fee of$100.00 due immediately.
<br /> 4) Liquidated damages:Because adual damages for breach of this Agreement,before commencement of work,may be difficult to determine,Purchaser shall pay to
<br /> LSCI,10%of the cash price stated in this Agreement as liquidated damages for a breach of Agreement that occurs before commencement of work.Once LSCI
<br /> furnishes any labor,services,or materials under this Agreement,LSCI will be entitled to actual damages plus 10�o if Purchaser breaches this Agreement.
<br /> 5) The undersigned authorized LSCI to verify and review their credit record with an independent credit reporting agency and release LSCI from any inadvertent
<br /> omissions or errors,if applicable.
<br /> 6) This Agreement is governed by the laws of the State of Florida.The exclusive venue for all legal proceedings relating to this Agreement is Pinellas County Florida.
<br /> Each par[y agrees that Pinellas County,Florida,is a proper and convenient venue for legal proceedings rising from this Agreement.Purchaser shall reimburse LSCI
<br /> for all costs and expenses incurred by LSCI in enforcing its rights under this Agreement,including without limitation,attorney's fees,court costs or associated costs
<br /> of investigating,preparing for prosecuting,defending against,or providing evidence producing documents or taking any other action(whether at trial,on appeal or
<br /> in bankruptcy or other proceedings)in connection with the enforcement of LSCI's rights under this Agreement.
<br /> 7) LSCI will only repair and replace non-structural exterior wood specified as per work order.
<br /> 8) This Agreement contains the final,complete and exclusive understanding between the parties and supersedes any prior or contemporaneous agreement,
<br /> understanding,or representation, oral or written,by either Purchaser or LSCI(except for loan documents executed by those parties with respect to this
<br /> Agreement ).An amendment or modification of this Agreement will be valid and effective only if it is in writing and signed by the party against whom the
<br /> amendment or modification is sought to be enforced.All changes,alteration,demands by the customer must be accomplished by change order Additional work
<br /> may require additional charges which the customer shall pay all increased amounts in excess of$100.00 charge at time of such changes.Equipment/color changes or
<br /> alterations by customer after materials are specifically ordered/tinted,as selected by customer,shall require an up charge due upon such change.
<br /> 9) LSCI shall exclude any structures or deck areas with swimming pools,spas or hot tubs for the purpose of pressure washing,spraying,repairing,replacing or
<br /> rescreening.No walkways,decks,floors or driveways shall be under warranty in reference to any exterior coating agreements.
<br /> Florida Statute 713.001-713.37:Accorcling to Construction Lien Laws,those who work on your propeKy or provide materials and services and are not paid in full have a
<br /> right to enforce their claim for payment against your property.This claim is known as a Construction Lien.If your contractor fails to pay subcontractors or material
<br /> suppliers,those who are owed money may look to your property for payment,even if you have paid your contractor in full.If you fail to pay your contractor,your
<br /> contractor may also have a right to file a lien on your property.This means if a Ifen is filed on your property,this property could be sold against your will to pay for labor,
<br /> materials or other services that your contractor may have failed to pay.To protect yourself,you can require your contractor to fumish you a written lien release after
<br /> project completion and monies paid to the Contractor If the contractor provided you with a"Notice to Owner",this notice must be posted on your property,if this action
<br /> is applicable.
<br /> Buyer's Right to cancel:If this is a home solicitation sale,and if you do not want the goods or services,you may cancel this agreement by providing written notice to
<br /> the seller(LSCI)in person,by telegram,or by mail.This notice must indicate that you do not want the goods or services and must be delivered or postmarked before
<br /> midnight of the third business day after you sign this agreement.If you cancel this agreement,the seller may not keep all or part of any cash down payment.
