CONDITIONS AND WARRANTIES <br /> 1. This proposai shall be a contract provided the BUYER signs acceptance within thirty(30)days from its <br /> date. <br /> 2. The materials and workmanship furnished under this proposal shall compiy with the rules and <br /> regulations set forth in applicable SXate and Local regulations <br /> 3. Any changes or additions in this proposal or the work installed hereunder shall be made in writing, <br /> setting forth the details of such changes and the cost thereof, and signed by both parties. <br /> 4. Aife ASSOC. sha11 not be held responsible or liable for any loss, damage, or delay caused by fire, <br /> strikes, civil or military authority, insurrection or riot, or by any other cause beyond its control, nor <br /> shall Aire ASSOC., be responsible for any consequential damages <br /> 5. The Buyer agrees not to sell, assign, or transfer any rights under this Contract or transfer <br /> possession of said material and/or fixtures without first inaking payrrient in full to the seller <br /> herein. <br /> 6. All payments under this agreement shall be ma�de wEthin�hirty(30)days from daie of invoice.Progress <br /> payments musi be paid in fufl prior to final work being performed. <br /> 7. Any agreements as to time on this contract shall be subjected to adjustment insofar as delay,by other <br /> trades, the contractor, owner, by out of state deliveries, by weather or other reasons beyond our <br /> Eontrol are concerned, arid addtional time allowed to compensate for same <br /> 8. In the event the manufacturer of materials or equipment, due to supply and demand, is unable to <br /> deliver designated equipment and/or materials, Aire Assoc., reserves the righ� to substit�te said <br /> equipment and/or materials with current available; of equal value, capabilities and design, at their <br /> discretion. <br /> 9. It is specifically agreed by the owner or contractor that any delay in payments pursuant to this <br /> agreement shall be our authorization to cease all work and this becomes an automatic intent to lien <br /> aforementioned property. <br /> 10. In the event Aire ASSOC. its assigns or successors,presents this contract to an attorney for handling, <br /> then the owner and/or agent atso agrees to re+mburse AifB ASSOC. for al-I callection or repossession <br /> expenses, including reasonable attomey's fees and interest of 18% per annum on past due balance. <br /> 1 i. All equipm8nt and devices installed as a part of this proposal shall be guaranteed for a period of one <br /> year from date of completion of this installation, except as otherwise noted, or in accardance with <br /> manufacturers warranty All work shall be performed during normal working hours, a one half time <br /> charge wi11 be in effect for all warranty work requested after hours. <br /> 12. Title to the above described material and/or fixtures shalf not pass but shall remain vested in and be <br /> the'property of Aire ASSOC., until fuli and final payment is received <br /> 13. The owner or agent agrees to provide sate job conditions as a prerequisite to performance hereunder <br /> by Aire Assoc. <br /> 14. BUYERS RfGHT TO CANCEL. You, The Buyer, may cancel this transaction without penalty or <br /> obiigation at any time prior to midnight of the third business day after the date of this transaction by <br /> notification to Aire ASSOC. <br />
