Petition for Conditional Use submitted by Jim Cook for property located at 5738 Cypress Street <br /> proposing to construct an accessory structure(File No. 24-12-CU)—APPROVED with special <br /> approval conditions <br /> Discussion <br /> • Verified that the accessory structure will meet the required 15'set-backs on the East and South <br /> sides of his property. Staff explained that he will have to meet with the Building Dept for a <br /> permit to build a drive-way with egress on 10�'Avenue. <br /> • After meeting with the builder, Mr. Cook requested to change the style of his roof to Gable and <br /> no one objected. <br /> Conditions <br /> Mr. Vande Berg read the following conditions into the record. The Planning,Department staff <br /> recommends approval of the conditional use petition for an accessory structure at 5738 Cypress <br /> Street with the following conditions: <br /> • The holder of a conditional use permit shall be authorized to utilize the site or location of the <br /> use only in the manner specified in the written approval and conditions specified therein. Any <br /> substantial expansion, alteration or change in the conditional use authorired by the written <br /> approval must be reviewed by the City Council in the same manner in which the original <br /> conditional use was reviewed: <br /> • For purpose of this section, an expansion, alteration or change of a conditional use shall be <br /> deemed to exist where a substantial modification of any of the standards provided for in <br /> condition 11 (a) above, results from activity associated with the conditional use or where a <br /> substantial change of circumstances or condition arises; <br /> • The conditions and stipulations shall become part of the written approval. and must be <br /> conformed to or followed by the applicant or any successor in interest; and <br /> • The proposed garage shall be constructed with a gable roof, side door and window, two garage <br /> doors, decorative exterior lighting with landscaping along the west side of the garage and the <br /> roof height not to exceed the height of the primary residence. <br />
