The term of thls A�reement shaq be flve (5)and a iraction y�rs,with the first year commenang o�the date APT begms consfiv�tion of the APT Facilities("Commencement Date')and terminating on the 31"day of December following the fifth annual �nive�sary of the Commencement Date (the "Initiaal Tertn"), unless othenNise bertninated as provided in Paragraph 9.
