ARTICLE 13. - 1'ERMINATlON OF CONTRACT BY THE OWNER: tf the Contractor defaults or <br /> neglects to carry out the work in accordance with the contract documents or fails to pertorm any provisions of <br /> the contract, the Community Deve(opment Division or the Owner ac#ing through the Community Development <br /> Division may, after seven (7) days' written notice, terminate this contract and finish the work by whatever <br /> method he deems expedient. If the unpaid balance of the contracf sum exaeeds the expense of finishing the <br /> wark, such excess shall be paid fia the Contractor; but if such expense exceeds such unpaid balance, the <br /> Contractor shall pay the difference to the Owner or the Community Development Division. Failure to pay the <br /> unpaid balance will result in disbarment from bidding on future Comrrtunity Development Division projects. <br /> ARTICLE 14. - TERMlNATION OF CONTRACT BY THE CONTRACTOR: If the Owner fails #o <br /> perform any applicable provisions of the contract, the Contractor may, upon seven (7) days' wrifte� no#ice to <br /> the Owner and the Community Development Division, terminate the contract, and recover from the Owner <br /> payment for all work satisfactorily completed and all other such remedies as are othervvise specified by law <br /> ARTICLE 9S. -GENERAL CONDITIONS: <br /> 15.1 The Work Write-Up shall take precedence over fhe basic speci�cation and, when in <br /> conflict, the materiaf, equipment, or workmanship called for in the "Work Write-Up"will <br /> be required. <br /> 15,2 The Drawinqs of floor pians are diagrammatic only, illustrating the general intention of <br /> the Owner; they do not show atl the work required, exact dimensions, or construction <br /> details. <br /> 15.3 The 2010 Bid Specifications are detailed in a separate book{et available to the Owner <br /> and the Contrac#or from the Community Development Division. <br /> 75.4 Workmanship shall be done in accordance with the standards of fhe several trades <br /> known as a "workmanfike manner." <br /> 15.5 Materials shail be new, in good condition, and of standard grade unless othen�+rise <br /> agreed in writing before their defivery to the job. <br /> 15.6 Repairs shall be made by the Contractar to all surfaces damaged by the Contractor <br /> resufting from his or his subcon#ractor's work under this contract at no additional cost <br /> to the Owner. Where "repair of existing work" is called for by the contract, the feature <br /> is to be placed in "equal #o new condition" either by patching or replacement; a!1 <br /> damaged, loose, or rotted parts shall be removed and replaced, and the finished work <br /> shall match adjacent wo�k in design and dimension. <br /> 15.7 Bids or Pro osals will be submitted a# Bidder's risk and the 4wner or the Community <br /> Development Division reserves the right to reject any or all bids or proposals. All bids <br /> or proposals are to be typed -nof hand written. <br /> 15.8 Buildinq Codes -All work to be done shalf be subject to the regulations of local building <br /> codes as inte�preted by the applicable City or County building departmentldivision <br /> whether or not covered by the specifications and drawings far the work. <br /> 15.9 Cleanua and removal from the site of all debris and waste materiais resufting from his <br /> work shall be the responsibility of the Contractor.
