It is eapressly sNpulated that this perntit is a license for permivsive use only and that the plecing of facilities upon public property pursuant to this perntit shall not operate to create or to vest any property right in said holder. 9. Whenever the City decides to further expbit the City Rights of Way,any or all said poles,wires,pipes,cables,or other facilities and appurte�nces authorized hereunder,shall be immediately removed from said Rights of Way,or reset or relocated thereim as required by the City Building Otticial at the expense of the holder of this permit 10. The holder shall save and keep the City harniless from a�ry and all danmges,rlai�,or injuries that may a-cur by reason of the construction, maiMena�e,and operation of said tacility. I1. The holder shall comple[e the requested work vrithin days or this permit shall bernme null and void.In the event the work requested is not completed upon the eapiration date otthis permit,the City shall I�ve the rigM to complete such work and to cha�ge the holder of the permk for all costs incurred in completing said work. 12. The holder shall post a cash or surety bond with the City Manager in the sum ot$ dollars to guarantee perfo►mance of the obligations herein,end to guarantce maintenance of the right-of-way described herein far a period of one(1)year following compkNon of the requeated installallon.In the event a surety bond is posted,the surety bond slmll be nmde payable to the City and shall oM date the surety to hdd the City harniless in the event the holder of this permit should feil to meet eny of its obligatiore hereunder.The bond shell aLso indemnify the City for all court costs and reasonable attorneys fees in the event legal action is required to collect on said bond.
