APT has the �ight but not the obligation from dme to time to pay any taxes, judgments, liens, <br /> assessments and/or any other charges autstanding whic are levied upon Owner or the �wner's Property and <br /> which are or in the future could become Ilens upon the ner's Property, in whote or in any part(individuaily and <br /> collectively, `Liens"). In the event that APT satisfies or ys any such Liens, in whole or in part, APT shall have <br /> the right but no duly to set off and offset any and a11 amou ts so paid against Rent and any other sums payable or <br /> to become payable pursuant to the terms of this Agreeme ("Rent and Other Charges"). If APT elects to set off or <br /> offset the amounts paid by APT against Rent and er Char+ges, immediately upon demand, Owner shall <br /> reimburse APT for ali sums paid by APT which exceed uch Rent and Other Charges. in the event that APT <br /> elects not t� set otf or offset the amounts paid by AP against Rent and Other Charges, immediatety upon <br /> demand,Owner shaff reimburse APT for all amounts paid APT. APTs rights m satisty or pay liens(in whole or <br /> in part}and then to set off and of�set as described in this ubparagraph include the right of APT to pay and set off <br /> and offset any and ali attomey's fees incuRed by APT in nnection with making such payments and/or obtaining <br /> such full or partial satisiac�ons. <br /> Q. Calocatton As�reements. APT shalt permitted to enter into agreements wEth third pafies <br /> wherein such third parties are permitted to co-locabe on th Communications Facility(a`Co-iocation AgreemenC). <br /> The following shall apply with respect to any Co-location reement entered lnto by APT: <br /> 1. In the event that APT rmits a third a to co-locate on the Communications Facility, APT <br /> shall pay to Owner of alf amounis ccllected as rent�under the terms <br /> of such Co-location Agreement The e amounts shall be due and payable to Owner within <br /> twenty {20) days after such amoun are coltected by APT. Fai{ure to make any such <br /> payment to Owne�shall be considere a default under this qgreement and shall entitle Owner <br /> to the same rights as in the event of a efault in the payment of Rent. <br /> 2. No Co-loca�on Agreement signed by AP7 shall extend beyond the Term of this Agreement <br /> without the Owner's prior written nsent, which shall not be unreasonably withheld cr <br /> delayed. If APT elects to extend this Agreement for one or more Renewal Terms, then, no <br /> Calocation Agreement executed by PT shalE extend beyond such Tertn, as extended.
