. � RESOLUTION NO.678-14 <br /> A RESOLUTIO RELATING TO ZONIIVG; APPROVING A <br /> CONDITIONAL SE TO ALLOW A PROPOSED ACCE�SORY <br /> STRUCTURE TH T EXCEEDS 625 SQUARE F�ET LOCATED AT 5050 <br /> 16�h STREET;PRO DING AN EFFECTIVE DATE. <br /> WHEREAS,an application was filed by Aaron Zook for a conditional use to allow an accessory <br /> structure that exceeds 625 s uare feet;and <br /> i WHEREAS, the condi�ion use is consistent with the standards as reflected in the City's Land <br /> i._. Development Code Section 1.10.00;and <br /> WHEREAS, Planning Co ission recommended approval of the conditional use with the <br /> following conditions: <br /> (1) The holder of a con itional use permit shall be authorized to utilize the site or location of <br /> the use only in the manner specified in the written approval and conditions specified therein. <br /> Any substantial expansion, lteration or change in the conditional use authorized by the written <br /> approval must be reviewe by the City Council in the same manner in which the original <br /> conditional use was review d: <br /> (2) Alteration or chang of a conditional use shall be deemed to exist where a substantial <br /> modification of any of the standards provided for in condition (1) above, results from activity <br /> associated with the conditi nal use or where a substantial change of circumstances or conditions <br /> arises: <br /> (3) The subject conditi ns and stipulations shall become part of the written approval and <br /> must be conformed to and llowed by the applicant or any successor in interest: <br /> , (4) The conditional use pproval shall run with the ownership of subject property: <br /> i <br /> � (5) The proposed garag shall comply with the following agreed to standards: a)garage roof <br /> ���- shall not exceed 15 feet 11 inches in height; b) structure will include two frondsepazate garage <br /> doors, a side door and 5 'ndows; c) construction material/siding (hardi board), metal roof to <br /> match that of the future pr mary residence; d) landscape strip to be placed along the east, south <br /> and west sides of the buildi g. <br /> (6) The future residenc to be built on site will be compatible/consistent with building/roof <br /> materials. <br /> (7) No Certificate of O cupancy("CO")shall be issued for the subject accessory building <br /> until the existing home is d molished and all debris is removed from the property. <br /> NOW 'THEREF , BE TT RESOLVED �Y 'i'HE CiTX COUNCIL O]F THE <br /> CITY OF ZEPHYRHIL S,FLORIDA: <br /> Section 1. The foregoing WHEREAS clauses are incorporated herein by reference and made a <br /> part hereof. <br /> Section 2. The conditiona use is approved for the benefit of the applicant only and for the use as <br /> ;" specified within the appli ation only, subject to the conditions herein.
