INSTR# 2022168239 OR BK 10662 PG 2917 Page 1 of 2 <br />07/29/2022 08:52 AM Rcpt: 2485756 Rec: 18.50 DS: 0.00 IT: 0.00 <br />Nikki Alvarez-Sowles, Esq., Pasco County Clerk & Comptroller <br />RERECORD TO CORRECT SCRIVENER'S ERROR <br />ORDINANCE NO. 1437-22 <br />AN ORDINANCE OF THE CITY OF ZEPHYRHILLS, FLORIDA <br />APPROVING A SMALL SCALE FUTURE LAND USE MAP <br />AMENDMENT TO THE CITY'S COMPREHENSIVE PLAN; CHANGING <br />THE FUTURE LAND USE DESIGNATION FROM COUNTY <br />INDUSTRIAL -LIGHT TO CITY IN (INDUSTRIAL), AND AMENDING <br />THE ZONING FROM COUNTY L1 TO CITY LI (LIGHT INDUSTRIAL), <br />FOR PARCEL 18-26-22-0010-01100-0000; PROVIDING FOR <br />CODIFICATION, SEVERABILITY AND AN EFFECTIVE DATE. <br />WHEREAS, the City Council has been given authority by the State of Florida pursuant to Chapter <br />163, Florida Statutes, to amend the Future Land Use Map of the City's territorial boundaries upon <br />written consent of the land owners, together with the approval of the City Council for said Future <br />Land Use Map amendment duly expressed by Ordinance; and <br />WHEREAS, the City Council has been given authority by the State of Florida pursuant to Chapter <br />163 and 166, Florida Statutes, to rezone property within the City Limits upon receipt of written <br />consent of the land owner, together with the approval of the City Council for said rezoning duly <br />expressed by Ordinance; and <br />WHERAS, due public notice of hearing on the proposed rezoning was given by the City Council <br />on June 2, 2022, as required by the Zephyrhills Land Development Code, as amended, and <br />Chapters 163 and 166, Florida Statutes; and <br />WHEREAS, the Planning Commission, sitting as the Local Planning Agency, did hold public <br />hearing on the 19th day of May, 2022 to consider said proposed Future Land Use Map amendment <br />and rezoning; and <br />WHEREAS, the Future Land Use Map amendment meets the criteria of a small scale map <br />amendment pursuant to Chapter 163, Florida Statues, and is consistent with the goals, objectives <br />and policies of the Comprehensive Plan; and <br />WHEREAS, the City Council has determined that the IN (Industrial) Future Land Use <br />classification would be appropriate and consistent with the city's Comprehensive Plan; and <br />WHEREAS, the City Council has determined that the LI (Light -Industrial) Zoning designation <br />would be appropriate, is consistent with the IN Future Land Use classification, and would promote <br />the general welfare and encourage proper development within the city. <br />NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Zephyrhills, <br />Florida, as follows: <br />Section 1: The Whereas Clauses above are true and accurate and are incorporated by reference <br />and made a part of this Ordinance. <br />Section 2: The following lands, lying and being situated in Pasco County, Florida to -wit: <br />Parcel/Tax ID No.: 18-26-21-0010-01100-0000 <br />Physical Address: 4904 Kittyhawk Drive <br />Legal Description: <br />Tract 11, Section 18, Township 26 South, Range 22 East, ZEPHYRHILLS <br />COLONY COMPANY LANDS according to the plat thereof as recorded in Plat <br />Book 1, Page 55, of the Public Records of Pasco County, Florida. <br />Acreage: 5.0 Acres (MOL) <br />the Future Land Use classification is hereby amended to City IN (Industrial) and <br />the Zoning designation is hereby changed to City LI (Light Industrial) and included <br />within the boundaries of the City of Zephyrhills, Florida <br />Section 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed to the <br />extent of such conflict. <br />- 1 - <br />
