INSTR# 202320$702 OR BK 10923 PG 2148 Page 1 of 2 <br />11/30/2023 09:18 AM Rcpt: 2647610 Rec: 18.50 DS: 0.00 IT: 0.00 <br />Nikki Alvarez-Sowles, Esq., Pasco County Clerk & Comptroller <br />X17.9 019n9011 <br />AN ORDINANCE OF THE CITY OF ZEPHYRHILLS, FLORIDA <br />ANNEXING ADDITIONAL TERRITORY TO BE INCLUDED WITHIN <br />THE BOUNDARIES OF SAID CITY DESCRIBED AS PARCEL NUMBER <br />03-26-21-0020-00000-0090LOCATED AT 6353 GALL BOULEVARD, <br />ZEPHYRHILLS, FL 33542 IN ACCORDANCE WIT ECT 171.044, <br />FLORIDA STATUTES, AS AMENDED, PROVIDINGA <br />EFFECTIVE DATE. <br />WHEREAS, the City is authorized by Chapter 171, Florida Statutes, to annex contiguous <br />and infill area, and to extend the City limits upon receipt of written consent of the land owner, <br />together with the approval of the City Council after public notice and public hearing; and <br />WHEREAS, the City has determined that said property is contiguous to the municipal <br />boundaries of the City, that the area of annexation is reasonably compact, and currently lies within <br />unincorporated Pasco County, and that the annexation of said property will not result in the <br />creation of any enclave; and <br />WHEREAS, ACC Investment Group, LLC, as owner of the lands described in Section 2 <br />below consented to annexation by the City of Zephyrhills of said lands described in Section 2 <br />below; and <br />WHEREAS, the Planning Commission, sitting as the Local Planning Agency, did hold <br />public hearing on the 19th day of September, 2023 to consider the proposed annexation; and <br />WHEREAS, due public notice of hearing on the proposed annexation was given by the <br />City Council on October 26, 2023 and November 16, 2023, as required by the Zephyrhills Land <br />Development Code, as amended, and Chapter 171, Florida Statutes; and <br />WHEREAS, the City Council has reviewed and evaluated the applications submitted, and <br />has determined that the annexation of said lands into the City is in the public interest and is <br />consistent with the City's Comprehensive Plan and Land Development Regulations. <br />NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Zephyrhills, <br />Florida, as follows: <br />SECTION l: The Whereas clauses above are true and accurate and are incorporated by <br />reference and made a part of this Ordinance. <br />SECTION 2: The following lands, lying and being situated in Pasco County, Florida to - <br />wit: <br />r � t �� t Ifii i�• <br />Physical Address: 6353 Gall Boulevard <br />Legal Description: <br />Lot 9, 10, 11, 12, LITTLE ACRES, ACCORDING TO THE MAP OR PLAT <br />THEREOF, AS RECORDED IN PLAT BOOK 5, PAGE 132. OF THE PUBLIC <br />RECORDS OF PASCO COUNTY, FLORIDA. TOGETHER WITH THAT <br />PORTION OF VACATED HOOVER STREET LYING EAST OF LOTS 9 AND <br />10 AND WEST OF LOTS I l AND 12 PER RESOLUTION 88-66 RECORDED <br />IN OFFICIAL RECORDS BOOK 1748, PAGE 180, OF THE PUBLIC RECORDS <br />OF PASCO COUNTY, FLORIDA <br />Acreage: 1.09 Acres (MOL) <br />the same are hereby annexed to and included within the boundaries of the City of <br />Zephyrhills, Florida, a municipal corporation. <br />SECTION 3: Said lands are contiguous to or are infill of the present City limits of the <br />City of Zephyrhills. Said lands are now unincorporated and lie in the same County as said City, <br />and when annexed would form a compact addition to the incorporated territory of said City. That <br />the owners of said lands contained in said area to be annexed have given written consent to have <br />such lands annexed into the boundaries of the City of Zephyrhills, Florida. <br />1 <br />
