<br /> disturbance, damage, clean-up or loss to interior praperty that Customer did not remove or protect prior to commencement of roofing '
<br />', operatians. Customer shall natify tenants of re-raofing and the need to pravide protection underneath areas being re-roofed. Customer
<br /> agrees to hoid Contractor harmless from claims of#enants who were not so notified and did not provide protection.
<br /> 9. Contractor and Customer are committed to acting promptly so tt�at roof leaks are not a souree of patential interior mold grawth.Customer
<br /> will make periodic inspections for signs of water intrusion and act piomptly,including notice to Contractor if Customer believes there are
<br /> roof Ieaks,to canect the candition.Upon receiving notice,Contractor wiII make repairs promptly so that water entry through the roafing
<br /> instailed by Contraetor is not a saurce of moisture.Contractor is no�responsible for indoar air quality. Customer sha21 hatd harmless and
<br /> indemnify Contractor from claims arising out of or relating io prope�rty damage,persanal injury,iliness,aliergic reactions,disease and!or
<br /> death resulting from tha occurrence or exposure to mold,mildew,fu�ngi,spores,and/or any ather hazardous chemical or biological agents.
<br /> I0. Contractor is nat responsible for adequacy of drainage or ponding on the roof. Contractor does not provide engineering, consulting,
<br /> architectural or design services. It is the Owner's responsibitity ta retain a licensed architeet or engineer to deterrnine proper design and
<br /> code compliance. Contractar is not responsible for design. Any change in specifications or construction necessary to conform to existing
<br /> or future building codes,zoning laws, or regulations af the inspecting I'ublic Authorities shzll be cansidered additional wark to be billed
<br /> , as an extra charge an a time and material basis.
<br /> 11. Workmanship warranty is non transferable.*
<br /> 12. Contractor's wprk will be warranted by Contractor in accordance with its standard wananty. A copy of Contractor's standard warranty is
<br /> attached or,if not,will be furnished upon request. Contractor SHALL NOT BE LIABLE FOR SPECIAL,PiJNITIVE,INCIDENTAL OR
<br /> CONSEQUENTIAL DAMAGBS. The acceptance of this propasat by the Customer signifies his agreement that this warranty shaIl be and
<br /> is the exclusive remedy against Contractor pertaining to the roaf inst�allation.
<br /> 13 Owner acknowledges and understands while the contractor is acti�ely completing the work nnder the cantract, the work environment,
<br /> inciuding al2 roof areas,is a dangerous environment. Owner agrees+not to interfere with the contractor from performing the duties under
<br /> this contract. Owner agrees nat to enter the work environment while wark is being perfarmed under this contract.
<br /> 14. If a dispute shall arise between Contractor and Customer with respect to any matters or questions arising out of or relating to this Agreement
<br /> or the breach thereof,such dispute,ather than colIection matters which may be handIed through arbitration or normal collection procedures,
<br /> shalI be decided 6y arbitration administered by and in accordancei with the Construction Industry Arbitration RuIes of the American
<br /> Arbitration Association and must be initiated within the appiicable statute of limitations. Thzs Agreement to arbiirate shalt be specifically
<br /> enforceable under the prevailing arbitration law. The award rendered by the arbitrators shall be final,and judgment may be entered upon
<br /> it in any Court having jurisdiction thereof. Any award shall include�court costs and reasonable attorney's fees to the prevailing party plus
<br /> interest at the Iegal rate. �

<br /> I eracke@ driveways,damages fram rain,hail,or any act of God. Any leaks dUe ta workmanship and materiats accnning during the Guarantee

<br /> 16. In the event that any conflict exists between any estimate of casts of constructian and the terms of this Contract,this Cantract shali be
<br /> cantrolling. With proper notice to the Owner, Contractor may substitute materials ihat are equai in quality to thase specifed if the
<br /> Contractor deems it advisable ta do so.
