_ i <br /> -� , <br /> the Subcontractor,will be corrected and the costs will be Back Charged to you,the <br /> Subcontractor. <br /> SUBCONTRACTOR RESPONSf�ILITI�S: Subcontractor should carefully examine the site as <br /> well as any plans, specifications and sefection sheets in order to be fuliy informed as to the <br /> existing conditions and to�the work of others in conjunction with Subcontractor's work, including <br /> any restrictions of working hours, use of freight elevators, delivery entrances andlor security <br /> _ procedures. Atl work will be completed in a good, neat and professional workman-like manner in <br /> � accordance with plans and specifications and in compliance with federal,state,or local <br /> requirements. All materials used shall be new, unless approved in writing, and of good quality <br /> and in the proper quan6ty required. The subcontractor must be able to provide a packing slip <br /> - generated by their supplier to support the materials and quantities used. All labor and material <br /> will be guaranteed against defects. Subcontractor is to fumish all necessary equipment,labor <br /> and materials to properly complete their scope of work within the specified schedule and such <br /> items are deemed included in the bid price. <br /> W.4RR�.(VTY: The Subcontractor warrants to the Owner, Client, and Contractor that materials <br /> and equipment fumished under this Subcontract will be of good quality and new unless required <br /> or permitted by the Subcontract documents,that the work of the Subcontractor will be free from <br /> defects not inherent in the qualiry required or permitted and that the work will conform to the <br /> requirements of the Su6contract documents and meet or exceed building standards. Work not <br /> conforming to these requirements,including subsfifutions not properly authorized,will be <br /> considered defective. Subcontractor agrees to provide a one('I)year warranty from the date <br /> Contractor receives final inspection or achieves Substantial Completion. Subcontractor agrees to <br /> respond to a request for warranty work within twenty-four(24)hours after receivirig a request and <br /> promptly correct the problem within five(5)working days,at Subcontractors expense. If <br /> � Subcontractar refuses or does not so perform within said time period, Contractor may contract for <br /> other Subcontractor services to perform and correct the probfem and bill original Subcontractar <br /> — for said expenses including but not limited to the labor and materials of another Subcontractor. <br /> SubconYractor shall be obfigated to pay any such biil immediately upon its receipt. <br /> GENERAL PROilISIOPIS: The Contractor may, at�any time,provide the Subcontractor with a <br /> written Notice to Subcontractor,indicating the nature of any problem(s}and providing the <br /> Subcontractor with a stated response time. Failure'to respond within the stated period will be <br /> considered a Breach of this Agreement and the Contractor may take whatever steps deemed <br /> necessary to keep the project on schedule,including but not limited to, suspending payments, <br /> replacing the Subcontractor and 8ack Charging all expenses including cost overruns. <br /> Subcontractor is responsible for any damages caused by Subcontractor's work force and by <br /> Subcontractor's suppliers or materials.The use of drugs or alcohol is strictly prohibited on or near <br /> any job site and will be grounds for immediate dismissal. Subcontractor is to leave premises <br /> clean daiiy(job to be broom swept)and all excess maferials neatly stacked where directed by ; <br /> Superintendent. Waste materials, boxes and similar materials are to be placed in dumpster or <br /> where directed by Superintendent. Subconiractor is responsible for keeping any debris away <br /> from adjoining properties. Contractor may back cha�ge the Subcontractor for clean-up work <br /> performed on their behalf at the rate of$65 per hou'r plus disposal fees.
