<br /> window leaks,those are to be repaired by others, nor is the contractor responsible for the disconnecting,reconnecting,reworking of replacing
<br /> of any satellite dishes,cables, lightning protection,electrical lines, lightning, plumbing, etc. This worl<needs to be done by others and paid by
<br /> the owner. SPC, insurance carriers are not responsible for Freon lines,electrical conduit/lines, plumbing or any other lines that are installed
<br /> too close to the roof sheathing and or not instafled properly to building code. SPC shall not be held liable or responsible for any injuries to
<br /> anyone other than its employees on the job site nor can SPC be held respons�ble for any damages or injuries by anyone falling through the roof ,
<br /> due to rotten or damaged roof decicing.
<br /> I5. ROOF DRAINAGE. A roof drainage is determined by the design and original construction of the building, SPC does not guarantee that
<br /> water will not remain on a flat roof. Any damage due to ponding water is not the responsibility of SPC or its insurance carriers. It is the
<br /> responsibility of the Customer to notify SPC of any known roof drainage problems on the low slope or flat roof areas. If after the Contractor
<br /> removes the roof inembrane,the roof deck is found to not have the repaired slope for positive drainage, a tapered insulation system wifl be '
<br /> installed to the roof deck to help enhance proper drainage. This will be billed at an additional charge and Customer agrees to pay SPC his
<br /> normal free charged to rectify the problem. It is agreed by Customer that this work will be done immediately in order to watertight the roof as
<br /> quickly as possible due to the roof being a low slope or flat roof. If the substrate roof condition results in ponding pursuant to the Florida
<br /> Building Code and modifications are required to correct the roof so ponding will not occur. �
<br /> 16. ROOF DECKING. If we discover that roof decl<ing is not properly nailed to code,we will bring it up to current building code.
<br /> Replacement of roof decicing will be made not to exceed four sheets of plywood.Over four will be charged to the customer.
<br /> 17. WARRANTY WORK. SPC is responsible under warranty to repair or replace at the company's discretion the roofing membranes and
<br /> associated flashings which are causing the leak. SPC is not responsible for any damage from normal loss of granules from the roof. Work
<br /> done or attempted to be done,on this roof by someone other than SPC or authorized agents relieves the warrantor from any further obligation.
<br /> All damages to embodied work in our contract caused by others will be repaired by us and charged to you at scheduled rates. Failure to keep
<br /> gutters,down and roof clean may void the warranty. SPC will provide a five year labor against leaks or workmanship and on steep, slope
<br /> shingle,tile and metal roof.One year warranty due to workmanship on flat roof Roof repairs have six months warranty.
<br /> 18. LECAL FEE AND COLLECTLON. Customer agrees to pay all collection fees and charges whether or not a suit is necessary including
<br /> but not limited to all legal and attorney's fees as well as filing fees and interest of any miscellaneous costs incurred to collect the debt should
<br /> the homeowner default in payment of any agreed upon installment payments due hereunder the entire principal balance shall at the option of
<br /> SPC make it become immediately due and payable without notice.A finance charge of 18% APR or the highest rate permissible
<br /> by law will be added to the balances over 10 days past due after completed worl<or passed inspection.
<br /> 19. FLORIDA STATUT�725.06. For and in consideration of$10 given by SPC to Customer and already reflected in the Agreement price,
<br /> the Customer shall defend, indemnify,and hold SPC, its officers,directors, agents and employees(indemnitee/indemnitees)harmless from and
<br /> against and al] claims,demands, losses,damages liabilities, expenses,costs, including attorney's fees,costs and expenses of investigation,
<br /> penalties, interest and amounts paid m settlement incurred or to be incurred by SPC arising out of relating to, or resulting from 1.personal
<br /> in�uiy 2. wrongful death,3. property damages, including claims for those damages caused partly or wholly as a result of the negligence or
<br /> wrongful acts of any of the indemnitees if the damages claimed relate to or arise out of, or are connected with the Agreement or the actions
<br /> necessary to perform same. The Customer's duty under this provision is limited to a total of ONE MILLION AND NO/000($1,000,000)
<br /> dollars for all damages, including costs and attorney's fees per occurrence for any single claim or suit.This Agreement shall be governed by
<br /> the laws of the State of Florida. Venue of any litigation or arbitration arising out of this Agreement shall be in Hillsborough County unless
<br /> parties hereto mutually agree otherwise. Should Contractor employ an attorney to institute litigation or arbitration to enforce any of the
<br /> provisions hereof,to protect its interest in any matter arising out of or related to this Agreement, SPC shall be entitled to recover from the
<br /> Customer all of its attorney's fees,costs,and expenses incurred herein, including attorney's fees, costs and expenses incurred at mediation,
<br /> administrative,appellate or banl<ruptcy proceedings.
<br /> 20. TERMS. Payment is to be made as follows• 50%down payment upon acceptance of the contract and the balance is due upon the
<br /> completion of the job. Credit card fees are paid by the Customer.

<br /> 22. PROGRESS PAYMENT.
<br /> A.$5,100 -first payment—down payment is required upon signin�the contract. Buyer receives copy of this contract.
