<br /> This Agreement made on 4/24/2017 by Scott Post Construction, Inc. (SPC)herein called as Contractor and wherein Judith Brunner
<br /> called as Property Owner/Designee and warrants that she/he has the authority to contract for roofing services on the property.

<br /> Job Description: 1.Reroof aprox 35 sq of shingles
<br /> This writing constitutes the entire agreement. All material is guaranteed as specified. All work shall be completed in a worlcmanlike manner
<br /> according to standard practices and all local building codes. The following additional provisions are expressly incorporated into this contract.
<br /> 1. LICENSES,PERMITS,SAFET'Y RULES, BUILDING CODES,ZONING,COMPANY INSURANCE AND OTHER LAWS.
<br /> SPC shall be liable to customer for obtaining building permits and inspections. SPC shall be responsible to Homeowner/Customer for the
<br /> compliance of safety rules and existing building codes,zoning ordinances and others laws. SPC shall comply with all laws relating to Workers
<br /> Co►npensation and carry Public L�ab�l�ty and Property damage standard form insurance. If a change occurs to any applicable safety rule,
<br /> building code,zoning and other ordinance which requires additional goods and installation services to perform the contract,the customer
<br /> agrees to pay the contractor the cost and reasonable profit for such goods and services. Copy of contract received by customer.
<br /> 2. DEED RESTRICTIONS. It is the sole obligation of the customer to determine the existence of restrictions contained in deeds,subdivisio[
<br /> or neighborhood regulations which might relate to or restrict the improvements under this contract. Contractor shall have no liability or
<br /> responsibility for any such non-confonnity with such restrictions/requirements. Contractor shall be entitled to be paid by Customer of all sums
<br /> due hereunder not withstanding any injunction/prohibition against the work as a result of any violation of such restriction/requirement.
<br /> 3. SCHEDULING. The start date discussed or assigned is an anticipated date,this date is subject to change due to weather conditions,delays
<br /> in material,required permitting,government, labor,vehicle breakdowns,sickness and any other conditions beyond the Contractor's control.
<br /> 4. CI-IANGE ORDERS. Should Customer,or any government agency require any modification to the work covered under this contract,any
<br /> cost incurred by Contractor shall be added to the contract price for extra wor]<and Customer agrees to pay SPC his normal selling price for
<br /> such work. All change orders must Ue followed with a written request and shall become a part of this contract and shall be incorporated herein
<br /> 5. DELAY. The SPC or its insurance carriers shall not be held responsible for any damages occasioned by delays. If Contractor is delayed at
<br /> anytime by any act or neglect of the customer or their representatives or any contractor employed by Customer or any changes ordered in the
<br /> work,the contractor shall be reimbursed or paid for the additional expense or damage. This shall include loss of equipment or rental caused by
<br /> said delay, In all cases involving worl<stoppage,extra work, changes or cancellations, it is agreed that the customer will pay the contractor for
<br /> its full cost of labor and materials plus 30%overhead, p(us 30%profits. SPC shall not be held liable for any damage or delay beyond the SPC
<br /> control. SPC is not responsible for price inflation and or increase due to national disasters,shortage of materials, increase in fuel/crude oil
<br /> costs,hurricane,tornadoes and other acts of God.
<br /> 6. ADVERTISING.Customer hereby grants SPC the right to display signs and advertise at the job site until payment in full has been made.
<br /> Customer grants SPC the right to publish the project street address on a"references" list,which may be given to prospective customers.
<br /> 7. GUTTERS. We recommend that gutters may be removed and re-installed by the gutter company although we cannot guarantee against
<br /> incide►ital damages. To avoid any damage to existing gutters,the homeowner should contact their gutter company to remove the gutters for
<br /> the new roof installation to be performed and have gutters reinstalled after new roof is completed.
<br /> � TGRMITES, PG�TS& HAZARDOUS S[JBS'TANCES. SPC �s not qualified or ficensed as an inspector or abatement contractor for
<br /> hazardous materials of for pests(including but not limited to termites). Should any hazardous substances or pests be suspected to be present
<br /> on the premises, it is the Customer's responsibility to arrange and pay for inspection and treatment. SPC cannot certify or warrant your •
<br /> building,free ofhazardous materials or pests. SPC and insurance carrier shall not be held liable for any damage due to termites,wood boars,o�
<br /> any wood destroying organisms after the work has been completed. SPC disclaims all liability for all claims,disputes,rights, losses,damages,
<br /> causes of action or controversies(claims)pertaining to Mold or mildew including claims arising out or relation to detection, cemoval, disposal
<br /> or remediation of Mold or Mildew,whether those claims arise in law, equity,contract,warranty,tort or federal or state statutory claims,and
<br /> whether those claims are based on the acts or omissions of SPC or individuals or entities under Contractor's control. The Customer is solely
<br /> I�able and responsible for all damages actual or consequential caused by mold or mildew.
<br /> 9. ADDYTIONAL WORK. This proposal does not cover the furnishing or erection of any wood work, painting,cutting, patching,electrical
<br /> or etc that might be required for the erection of the work covered in this contract unless specifically mentioned above. Additional layers or
<br /> roofing under the original roof will be$25.00 per square per layer and is not part of the original contract. SPC has the discretion to take the
<br /> necessary precaution to the flashing or skylight replacement to ensure a complete watertight roof system. The customer agrees to pay the SPC
<br /> for his nonnal fees foc skylight replacement. SPC will not be responsible foc debris falling inside frotn skyfight durmg the install, it is the
<br /> Customers responsibility to cover furnishing, and etc. SPC is not responsible for sl<yfights that need to be replaced or for skylights that are not
<br /> normal size and need to be special ordered. HURR6CANE CLIPS: Yes No X
<br /> 10 MANUFACTURE�2 LIAI3IL!'p'Y. SPC shall not be held responsible for any product manufacturing defects or product availability.
<br /> 11. UNSEEN OR HIDDEN PROBLCMS. It is not the Contractor's responsibility for bowed wood or dips in the decking. Should concealec
<br /> or unknown conditions in an existing structure be at a variance with conditions indicated in the description of the work to be pei•formed from
<br /> those ordinarily encountered and generally recognized as inherent in work of the character provided for in this agreement. The agreement price
<br /> shall be equitably adjusted upon notice thereof from the SPC to the Customer. If there is an increase �n the price of the products charged
<br /> by the Contractor in excess of 5%subsequent to making this proposal/contract,tlle price set forth in this proposal/contract shall be increased
<br /> without the need for a written change order or amendment to the contract to reflect the price increase and additional direct cost to the
<br /> Contractor Contractor wil]submit written documentation of the increased charges to the Customer.
<br /> 12. C�.�A!�(l'IP. SPC���ill leave pr.en�ises on a r.eat,_broom clean condition. Any_debris consisting of dust,dirt,asphalt or small bits or
<br /> materials that settle into attics, garage area or any other area being worked over with opening beams ceiling or attic, is unavoidable and SPC -
<br /> is not responsible for this cleanup.
<br /> 13. MATERIALS. Customer and SPC mutually agree that any color,mal<es,written on the contract are chosen by the Customer Prices in
<br />'� all material used for the project are subject to change,due to an increase in costs of goods or services resulting from circumstances beyond the
<br /> Contractors control such as federal mandates, embargoes. economic turmoil, military conflict, strikes, war(declared or undeclared)riots, delays
<br /> Iby carriers,shipment or receipt of materials from supplier, shortage of mate►•ials delayed production or increase in fuel/crude oil costs.
<br /> 14. CONTRACTOR LIABILITY. SPC or its insurance carriers shall not be responsible for conditions which depart from conventional
<br /> building designs, �ncludin�but not limited to damaged decking, insulation, trusses, walls, siding foundations,driveways, sidewallcs, ceilings,
<br /> slcylights,plumbing,electrical,air conditioning or lines, drains and othec roof mounted equipment. SPC and its insurance carriers shall not
<br /> be held responsible for any damages that may occur during construction pro�ect: damaged,cracl<ed, or broken driveway or sidewalks, lawns,
<br /> gardens,damage to plants,floral or scrubs,garage doors,foundations, othec structures, buildings or portions thereof,sprinkler systems,wells,
<br /> or any damage to septic tanks or drain fields. The Customer shall provide access for heavy equ�pment. Magnets will be used around the
<br /> property, during the roofing project and after the completion of the roof, but due to the nature of the industry,some fasteners/nails may remain
<br /> trapped in the grass or bttshes. SPC,suppliers and insurance carriers shall not be responsible for the damage to the interior of buildings due to
<br /> normal vibration associated with the roofing process. Items not securely fastened on any interior or exterior walls or ceiling should be
