<br /> THE CITY OF ZEPHYRHILLS, FLORIDA,
<br /> ANNEXING ENCLAVES, WHICH ARE
<br /> ADDITIONAL TERRITORIES TO BE INCLUDED
<br /> WITHIN THE BOUNDARIES OF SAID CITY
<br /> PURSUANT TO THAT CERTAIN INTERLOCAL
<br /> AGREEMENT BETWEEN PASCO COUNTY AND
<br /> THE CITY OF ZEPHYRHILLS AND IN
<br /> ACCORDANCE WITH FLORIDA STATUTE
<br /> 171.046(2)(a) LAWS OF FLORIDA. ,

<br /> WHEREAS, LAWRENCE A. KIEPER and PATRICIA C. KIEPER, his wife, are the
<br /> present owners of the lands hereinafter described in Section 1, and
<br /> WHEREAS, the properties described in Section 1 below created an enclave within the
<br /> incorporated boundaries of the City of Zephyrhills,
<br /> WHEREAS, pursuant to Florida Statute 171.046(2)(a), the City of Zephyrhills and Pasco
<br /> County have entered into an interlocal agreement to annex said enclaved properties into the City
<br /> limits of the City of Zephyrhills,
<br /> WHEREAS, a public hearing was conducted by the City Council of the City of Zephyrhills
<br /> on the 8th day of July, A.D., 2002, and the Board of County Commissioners of Pasco County on the
<br /> 15th day of October, A.D., 2002.
<br /> WHEREAS, LAWRENCE A. KIEPER'and PATRICIA C. KIEPER, his wife were
<br /> notified of the public hearing for annexation by regular mail and registered mail, return receipt of the
<br /> lands described in Section 1, and
<br /> WHEREAS, the Board of County Commissioners of Pasco County and the City Council of
<br /> the City of Zephyrhills approves the annexation of said lands and the inclusion_of said lands within
<br /> the corporate limits of said City,
<br /> WHEREAS, the Planning Commission has recommended approval of the annexation.
<br /> NOW, THEREFORE,BE IT ENACTED AND ORDAINED by the City Council of the City
<br /> of Zephyrhills, Florida, as follows:
<br /> SECTION 1: That the following described enclaved lands, lying'and.being situate-in Pasco
<br /> County, Florida, to-wit: -
<br /> 03-26-21-0010-09600-0020
<br /> The North 1/2 of Tract 96, ZEPHYRHILLS COLONY COMPANY LANDS, in Section 3,
<br /> Township 26 South, Range 21 East, as per plat thereof recorded in Plat Book-1 page 55, Public
<br /> Records of Pasco County, Florida, lying East of the S.A.L. Railroad and` J.S. 301, also including a
<br /> 15 foot wide alley on the East side of the North 1/2 of Tract 96, as described herein and as per board
<br /> Minute Book 25, Pages 659-660.
<br /> be, and the same are hereby annexed to and included within the boundaries of the City of
<br /> Zephyrhills, Florida, a municipal corporation. 1
