Words not defined herein shall have the meaning <br /> subscribed to them in Title 47, Section 522, United States Code, as amended from time <br /> to time. Where any inconsistencies may arise, the definition assigned by the United <br /> States Code shall be controlling. When not inconsistent with the context, words used in <br /> the present tense include the future, words in the plural number include the singular <br /> number, and words in the singular number include the plural number. Words of the <br /> masculine gender shall be deemed and construed to include correlative words of the <br /> feminine gender. The word "shall" is mandatory and not merely directory. <br /> A. "Access Channel" means a Channel or Channels the programming of <br /> which is provided by groups or members of the public, educational institutions, or the <br /> government, and is retransmitted by the Grantee. <br /> B. "Activated Channels" means those Channels engineered at the headed <br /> of a cable system for the provision of services generally available to residential <br /> subscribers of the cable system, regardless of whether such services are actually <br /> provided, including any channel designated for public, educational, or governmental use. <br /> C. "Basic Cable System" means any service tier which includes the <br /> retransmission of local television broadcast signals. <br /> D. "Cable Act"means the Communications Act of 1934, 47 U.S.C. Sections <br /> 151-611, as amended by the Cable Communications Policy Act of 1984, the Cable <br /> Television Consumer Protection and Competition Act of 1992, and the <br /> Telecommunications Act of 1996, and including any further amendments made thereto. <br /> E. "Cable Channel" or "Channel" means a band of frequencies in the <br /> electromagnetic spectrum, or any other means of transmission (including, without <br /> limitation, optical fibers or any other means now available or that may become available), <br /> which is capable or carrying a video signal, an audio signal, a voice signal, or a data <br /> signal. <br /> F. "Cable Service" means (1) the one-way transmission to subscribers of <br /> video programming or other programming service, and (2) subscriber interaction, if any, <br /> which is required for the selection or use of such video programming or other <br /> programming service. <br /> G. "Cable Television System" or "Cable Communications System" or <br /> "System" or "Cable Television" or "CATV" means any facility, all or a portion of <br /> which is located in the City, consisting of a set of closed transmission paths and _ <br /> associated signal generation, reception, and control equipment, that is designed to <br /> provide Cable Service to Subscribers, but such term does not include: <br /> (i.) a facility that serves only to retransmit the television signals of one or <br /> more television broadcasting stations; <br /> (ii.) a facility that serves Subscribers without using any public way(s); <br />
