Box U07,I:and 0 Li*es,n.11639 BuRding Agreement Office:(813)477 3428 Fax:(813)9204M4 Lie#I CGC1509941 Articles of Agreement made and entered into this 16 day of January 2019 by and between Berme Diaz (hereinafter referred to as the "Owner" and/or `Buyer,"which shall include plural, as the context requires), whose present mailing address is 39109 Tucker Road„ Zephyrhills. FL 33542, and Wentra Construction,Inc.a Florida Corporation(hereinafter referred to as the"Contractor'). FIRST: The Contractor promises and agrees to and with the Owner that he will, for the consideration hereinafter mentioned, construct, finish and deliver a residence on land owned by Owner, situated in the Tampa, Hillsborough County, Florida, and having the street address of 39109 Tucker Road.,Zenhyrhills,FL 33542. SECOND: That the Owner promises and agrees to and with the Contractor that she will and shall in consideration of the agreements being executed and performed by the Contractor as specified,-pay or cause to be paid to the Contractor the contract price of: (a) Base Price+Electrical $ 243,000.00 (b) Contract Addenda A-1 $ 00.00 (c) Net Sales Price $ 243,000.00 (d) Deposit $ 36,450.00 (e) Balance $ 206,550.00 All payments shall be due within seven(07) days after the receipt of written notice to the Owner at the above address. All payments shall be payable to the Contractor at its above address. Base price includes all materials (except those indicated as Owner Supplied), Architectural Plans, Structural Engineering, Permit, Removal of all construction debris from the site, and Restoration of the site to its original condition. All payments shall be payable to the Contractor in U.S. Dollars in the following manner. 1. $36,450.00 due as down payment 2. $47,385.00 due upon completion of Block Stage 3. $47,385.00 due upon completion of Framing 4. $47,385.00 due upon completion of Drywall Stage 5. $47,385.00 due upon MEP Trim Out Stage 6. $17,010.00 due upon final walk with Owner(s) Subject to the provisions of the agreement,the Contractor agrees to use its best effort to deliver the completed residence specified herein on or about-214-days from the start of construction.The start of construction is defined as the date on which the footings are poured,or in the case of monolithic slab, the day rough plumbing is begun. HOWEVER,THE CONTRACTOR CANNOT AND WILL NOT BE RESPONSIBLE FOR ANY DAMAGES OR INCONVENIENCES CAUSED THE OWNER FOR FAILURE TO COMPLETE THE RESIDENCE SPECIFIED HEREIN WITHIN THE ABOVE NUMBER OF DAYS REGARDLESS OF THE REASON OF SUCH DELAY. Owner agrees that Contractor shall have the right to substitute material or items of comparable quality for such material or items which may be unobtainable because of strikes or discontinuance of such substitutions, giving advance notice where possible. The Owner acknowledges that no officers, employee, agent, or subcontractor of Wentra Construction,Inc.is authorized to guarantee a delivery date in anyway.
