Box U07,I:and 0 Li*es,n.11639 <br /> BuRding Agreement <br /> Office:(813)477 3428 Fax:(813)9204M4 Lie#I CGC1509941 <br /> Articles of Agreement made and entered into this 16 day of January 2019 by and between <br /> Berme Diaz (hereinafter referred to as the "Owner" and/or `Buyer,"which shall include plural, as the <br /> context requires), whose present mailing address is 39109 Tucker Road„ Zephyrhills. FL 33542, and <br /> Wentra Construction,Inc.a Florida Corporation(hereinafter referred to as the"Contractor'). <br /> FIRST: The Contractor promises and agrees to and with the Owner that he will, for the <br /> consideration hereinafter mentioned, construct, finish and deliver a residence on land owned by Owner, <br /> situated in the Tampa, Hillsborough County, Florida, and having the street address of 39109 Tucker <br /> Road.,Zenhyrhills,FL 33542. <br /> SECOND: That the Owner promises and agrees to and with the Contractor that she will and shall <br /> in consideration of the agreements being executed and performed by the Contractor as specified,-pay or <br /> cause to be paid to the Contractor the contract price of: <br /> (a) Base Price+Electrical $ 243,000.00 <br /> (b) Contract Addenda A-1 $ 00.00 <br /> (c) Net Sales Price $ 243,000.00 <br /> (d) Deposit $ 36,450.00 <br /> (e) Balance $ 206,550.00 <br /> All payments shall be due within seven(07) days after the receipt of written notice to the Owner <br /> at the above address. All payments shall be payable to the Contractor at its above address. Base price <br /> includes all materials (except those indicated as Owner Supplied), Architectural Plans, Structural <br /> Engineering, Permit, Removal of all construction debris from the site, and Restoration of the site to its <br /> original condition. All payments shall be payable to the Contractor in U.S. Dollars in the following <br /> manner. <br /> 1. $36,450.00 due as down payment <br /> 2. $47,385.00 due upon completion of Block Stage <br /> 3. $47,385.00 due upon completion of Framing <br /> 4. $47,385.00 due upon completion of Drywall Stage <br /> 5. $47,385.00 due upon MEP Trim Out Stage <br /> 6. $17,010.00 due upon final walk with Owner(s) <br /> Subject to the provisions of the agreement,the Contractor agrees to use its best effort to deliver <br /> the completed residence specified herein on or about-214-days from the start of construction.The start <br /> of construction is defined as the date on which the footings are poured,or in the case of monolithic slab, <br /> the day rough plumbing is begun. HOWEVER,THE CONTRACTOR CANNOT AND WILL NOT BE <br /> RESPONSIBLE FOR ANY DAMAGES OR INCONVENIENCES CAUSED THE OWNER FOR <br /> FAILURE TO COMPLETE THE RESIDENCE SPECIFIED HEREIN WITHIN THE ABOVE <br /> NUMBER OF DAYS REGARDLESS OF THE REASON OF SUCH DELAY. Owner agrees that <br /> Contractor shall have the right to substitute material or items of comparable quality for such material or <br /> items which may be unobtainable because of strikes or discontinuance of such substitutions, giving <br /> advance notice where possible. The Owner acknowledges that no officers, employee, agent, or <br /> subcontractor of Wentra Construction,Inc.is authorized to guarantee a delivery date in anyway. <br />
