Possession of the premises shall not be delivered to the Owner until the residence has been fully <br /> constructed and the full contract price has been paid to the Contractor. It is agreed that the Contractor will <br /> deliver a notice of occupancy to the Owner,and that the Owner shall,within ten(10)days after receipt of <br /> said notice, make final payment to the Contractor. Time is of essence in this agreement. At the time of <br /> such final settlement, an affidavit of"no liens"covering all materials and labor will be presented to the <br /> Owner by the Contractor. It is expressly understood and agreed that the Owner is not to occupy or <br /> otherwise take possession of the premises being improved pursuant to this contract prior to such final <br /> settlement, unless written consent to such occupancy prior to settlement is granted to the Owner by the <br /> Contractor,and the Owner,prior to such occupancy,have paid the full contract price to the Contractor. <br /> The above price is guaranteed to Owner for 45 days through February 28,2019,or until the start <br /> of construction if such start is delayed beyond this time by the Contractor.Should start of construction be <br /> delayed beyond this time by Owner,or due to ruling or regulation of any governmental authority,or due <br /> to any other cause not the fault of the Contractor,then the above price will be adjusted to include all price <br /> changes occurring 60 days after the date of this Building Agreement. THE CONTRACTOR RESERVES <br /> THE RIGHT TO CANCEL THE BUILDING AGREEMENT IF CONSTRUCTION DOES NOT START <br /> WITHIN SIXTY(60)DAYS FROM THE DATE OF THIS BUILDING AGREEMENT. <br /> THIRD: The said residence to be Contractor's Model Name (Diaz Residence) Product Line: <br /> Wentra Construction,Inc.,with details of material and construction to be comparable to those used in the <br /> Standard Features sheet dated: 01/16/2019 for such changes as set out on Section 2-B of this <br /> Agreement.Plans and specifications of this home are subject to any change necessitated by Governmental <br /> Regulations. <br /> FOURTH: Should the Owner at any time during the progress of said residence desire any <br /> alterations to or deviations from, additions to, or omissions of said agreement, such change or changes <br /> shall be made when practicable, provided they are acceptable to the Contractor. Any alteration or <br /> modification of this Agreement shall be effective only if made in writing signed by both parties; no oral <br /> modification shall be effective or binding. Provided such modification is made in writing, it shall in no <br /> way injuriously affect or void this Agreement;the cost differences shall be added to or deducted from the <br /> amount of the Agreement,as the case may be, by a fair and reasonable valuation. Upon approval by the <br /> Owner of their customer approval plans,Contractor may then produce production prints for distribution to <br /> subcontractors and suppliers. Should changes be required by the developer of the subdivision where said <br /> lot is located, or by competent municipal or other governmental authority having jurisdiction over <br /> construction practices on said lot, such changes shall be made at the owner's expense. Such written <br /> modifications may lengthen the time required for construction by a number of days as specified by the <br /> Contractor in each written modification_The previously estimated completed residence delivery date shall <br /> be extended by a number of days equal to the cumulative number of days specified in all written contract <br /> modifications. <br /> FIFTH: Each change requested by the Owner subsequent to said customer approval plan shall <br /> carry a surcharge of S100.00 per change in addition to the regular charge or credit attendant to the change <br /> requested and is subject to construction department approval. <br /> SIXTH: The Contractor will furnish Builders Risk Insurance in the full amount of this contract <br /> during the construction period. Contractor will also furnish Workman's Compensation and General <br /> Liability Insurance. <br /> SEVENTH: It is hereby agreed that the installation of Water/Electric meter and necessary <br /> surveys including a fresh shakeout of the lot will be at the expense of the Owner. The Owner will pay <br /> utility company bills for electricity and water used during construction.
