INSTR# 2021027645 OR BK 10276 PG 3886 Page 1 of 2 <br />02/10/2021 11:03 AM Rcpt: 2259566 Rec: 18.50 DS: 0.00 IT: 0.00 <br />Nikki Alvarez-Sowles, Esq., Pasco County Clerk & Comptroller <br />ORDINANCE NO. 1412-21 <br />AN ORDINANCE OF THE CITY OF ZEPHYRHILLS, FLORIDA, <br />APPROVING A ZONING PUD (PLANNED UNIT DEVELOPMENT) <br />MASTER PLAN AMENDMENT FOR TROTTER'S CROSSING; FOR <br />PARCEL 27-25-21-0010-00300-0000 AND A PORTION OF 27-25-21-0030- <br />04900-0000 PROVIDING FOR CODIFICATION, SEVERABILITY, AND <br />AN EFFECTIVE DATE. <br />WHEREAS, the City Council has been given authority by the State of Florida pursuant <br />to Chapter 163 and 166, Florida Statutes, to rezone property within the City Limits upon receipt <br />of written consent of the land owner, together with the approval of the City Council of said <br />rezoning duly expressed by Ordinance; and <br />WHEREAS, due public notice of hearing on the proposed rezoning was given by the <br />City Council, as required by the Zephyrhills Land Development Code, as amended, and Chapters <br />163 and 166, Florida Statutes; and <br />WHEREAS, the Planning Commission, sitting as the Local Planning Agency, did hold a <br />public on December 15, 2020 hearing to consider said proposed PUD zoning amendment and has <br />recommended approval; and <br />WHEREAS, the City Council has determined that the PUD (PLANNED UNIT <br />DEVELOPMENT) zoning amendment would be appropriate, would promote the general <br />welfare, and would encourage proper development within the City; and <br />NOW, THEREFORE, BE IT ENACTED AND ORDAINED BY THE CITY COUNCIL <br />OF ZEPHYRHILLS, FLORIDA, AS FOLLOWS: <br />SECTION 1: The above Whereas clauses are hereby adopted and incorporated herein. <br />SECTION 2: The following described lands, lying and being situated in Pasco County, to wit: <br />Parcel Id No.: 27-25-21-0010-00300-0000 & 27-25-21-0030-04900-0000. <br />Physical Address: None <br />Legal Description: <br />ZEPHYRHILLS COLONY COMPANY LANDS PB 1 PG 55 A PORTION OF TRACTS 127 & <br />128 DESC AS FOLLOWS:COM AT SE COR OF SEC 27 TH S89DEG 2715311W ALG <br />SOUTHBDY OF SEC 27 15 FT TH NOODEG 30'00"E 15 FT TO SE COR OF TRACT 128 TH <br />S89DEG 27'53"W 640.02 FT FOR POB TH CONTINUE S89DEG 27'53"W ALG SOUTH <br />BDYOF TRACTS 127&128 204.58 FT TH NOODEG 38'16"E 213.12 FT TH N89DEG 27'53"E <br />204.58 FT TH SOODEG 38'16"W 213.12 FT TO POBOR 9659 PG 864 <br />Assessed in Section 27, Township 25 South, Range 21 East of Pasco County, Florida <br />30.476 -Acres (MOL) <br />the zoning designation is hereby rezoned to City PUD (Planned Unit Development). <br />The following Zoning conditions shall apply: <br />l.) City water and sewer shall be provided to the subject property; <br />4.) A FDOT ROW and Utility permit shall be required to be obtained for improvements <br />completed in the FDOT ROW and provide a copy of issued permits to the City Planning <br />Department; <br />5.) Developer / Builder shall minimize lot grading and utilize the existing topography to the <br />greatest extent possible to conserve the existing topography to the greatest extent possible <br />
