INSTR# 2023208701 OR BK 10923 PG 2146 Page 1 of 2 <br />11/30/2023 09:18 AM Rcpt: 2647609 Rec: 18.50 DS: 0.00 IT: 0.00 <br />Nikki Alvarez-Sowles, Esq., Pasco County Clerk & Comptroller <br />ORDINANCE NO. 1464-23 <br />AN ORDINANCE OF THE CITY OF ZEPHYRHILLS, FLORIDA, <br />APPROVING <br />CHANGINGAMENDMENT TO THE CITY'S COMPREHENSIVE PLAN; <br />%; USE MAP DESIGNATION <br />COUNTY ROR TO CITY MU (MIXED USE), AND AMENDING THE <br />ZONING FROM COUNTY C2 TO CITY C2 (COMMUNITY <br />COMMERCIAL), FOR PARCEL NUMBER is , tr 00 0 - <br />LOCATED AT 6353 GALL BOULEVARD, ZEPHYRHILLS, FL 33542, <br />PROVIDING FOR CODIFICATION, REPEALER, SEVERABILITY, <br />AND AN EFFECTIVE D. <br />WHEREAS, Chapters 125 and 163 Florida Statutes, authorize the City Council of the <br />City of Zephyrhills, Florida to prepare and enforce a Comprehensive Plan for the development <br />of the City; and <br />WHEREAS, the City Council has determined that the proposed amendment meets the <br />criteria for a Small -Scale Comprehensive Plan Amendment pursuant to Section 163.3184, <br />Florida Statutes, and the Zephyrhills Comprehensive Plan; and <br />WHEREAS, the Zephyrhills Planning Commission, on September 19, 2023, held a <br />public meeting on the proposed amendment to the Comprehensive Plan with due public notice, <br />pursuant to Section 125.55(2), Florida Statutes, and recommended approval to the City Council: <br />and <br />WHEREAS, the City has complied with all requirements and procedures of Florida lata- <br />in processing this amendment to the City of Zephyrhills Comprehensive Plan including, but not <br />limited to, Section 163.3184, Florida Statutes; and <br />WHEREAS, the proposed Future Land Use Map amendment meets the criteria of ,1 <br />large-scale Future Land Use Map amendment and is consistent with the goals, objectives and <br />policies of the Comprehensive Plan; and <br />WHEREAS, the City Council has determined that the Mixed Use (MU) future land use <br />classification would be appropriate, would promote the general welfare, and would encourage <br />proper development within the City; and <br />WHEREAS, the City Council has determined that the Community Commercial (C2) <br />zoning designation would be appropriate, would promote the general welfare, and would <br />encourage proper development within the City; and <br />WHEREAS, the City Council desires to hereby formally adopt the Amendment to the <br />City's Comprehensive Plan, <br />NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of <br />Zephyrhills, Florida, as follows: <br />SECTION 1: The Whereas Clauses above are true and accurate and are incorporated by <br />reference and made a part of this Ordinance. <br />SECTION 2: This Ordinance is enacted pursuant to Chapter 163, Florida Statutes, and <br />under the home rule powers of the City. <br />SECTION 3: The following described lands, lying and being situated in the City of <br />Zephyrhills, to wit: <br />Legal Description: Lot 9, 10, 11, 12, LITTLE ACRES, ACCORDING TO THE <br />MAP OR PLAT THEREOF, AS RECORDED IN PLAT BOOK 5, PAGE 132. OF <br />THE PUBLIC RECORDS OF PASCO COUNTY, FLORIDA. TOGETHER <br />WITH THAT PORTION OF VACATED HOOVER STREET LYING EAST OF <br />LOTS 9 AND 10 AND WEST OF LOTS I I AND 12 PER RESOLUTION 88-66 <br />RECORDED IN OFFICIAL RECORDS BOOK 1748, PAGE 180, OF THE <br />PUBLIC RECORDS OF PASCO COUNTY, FLORIDA. <br />1 <br />
