INSTR# 2024061972 OR BK 10991 PG 1897 Page 1 of 9 <br />04/12/2024 03:00 PM Rcpt: 2690654 Rec: 78.00 DS: 0.00 IT: 0.00 <br />Nikki Alvarez-Sowles, Esq., Pasco County Clerk & Comptroller <br />ORDINANCE NO. 1474-24 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />ZEPHYRHILLS, AMENDING THE CITY OF ZEPHYRHILLS LAND <br />DEVELOPMENT SECTION 5.04.01 DETERMINATION OF PROJECT <br />IMPACT; AMENDING SECTION 7.03.01 TRAFFIC STUDY <br />REQUIREMENTS, AMENDING THE EXISTING DE MINIMIS AND <br />TRAFFIC IMPACT ANALYSIS TRAFFIC STUDY REQUIREMENTS; <br />AMENDING TABLE 1 AND TABLE 2 OF SECTION 7.03.01; AMENDING <br />THE TRANSPORTATION MITIGATION (TURN LANE CRITERIA) AND <br />ROADWAY AND INTERSECTION IMPROVEMENTS CRITERIA; <br />PROVIDING FOR REPEALER, CODIFICATION AND AN EFFECTIVE <br />DATE. <br />WHEREAS, the City Council has determined that it is in the City's interest to update the <br />Land Development Code from time to time to assure that the Land Development Code adequately <br />meets the needs of the City; and <br />WHEREAS, the City Council has determined that Increasing development in the City of <br />Zephyrhills continues to affect operations on roadways within the City, and the need for a more <br />standardized (and stringent) driveway turn lane criteria has become necessary to improve safety, <br />capacity, and more efficient transportation operations <br />WHEREAS, the City Council desires to amend the City of Zephyrhills' Land <br />Development Code as it relates the existing de minimis and traffic impact analysis traffic study <br />requirements, the Transportation Mitigation (Turn Lane Criteria) and Roadway and Intersection <br />Improvements Criteria; <br />WHEREAS, the City Council desires to hereby formally adopt the amendment to the City <br />of Zephyrhills Land Development Code. <br />NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of <br />Zephyrhills, Florida, as follows: <br />Section 1. Recitals. <br />The Whereas Clauses above are true and accurate and are incorporated by reference <br />and made a part of this Ordinance. <br />Section 2. Authority. <br />This Ordinance is enacted pursuant to Chapter 163, Florida Statutes, and under the <br />home rule powers of the City. <br />Section 3. Amendments. <br />Section § 5.04.01 DETERMINATION OF PROJECT IMPACT of the City of <br />Zephyrhills Land Development Code is hereby amended as follows: <br />§ 5.04.01 DETERMINATION OF PROJECT IMPACT. <br />An application for a Comprehensive Plan amendment, a rezoning or site plan approval <br />of a proposed development shall determine the impact of the project by the following <br />procedures: <br />(A) A traffic ;,,,,,. ael anal study shall be prepared by the developer or his or her <br />designee that includes a projection of the gross daily PM Peak -Hour trips to be generated <br />by the project and the distribution of the trips onto adjacent streets. Institute of Traffic <br />Engineers trip generation rates or another approved source shall be used as the basis for <br />trip generation calculations. <br />1 Proposed additions to text of City Code of Ordinances are indicated by underline; proposed deletions from text of City Code of <br />Ordinances are indicated by strikethroug . <br />
