The Owner and Contractor may <br />communicate with each other through the Architect about matters arising out of or relating to the <br />Contract. Communications by and with the Architect's consultants shall be through the Architect. <br />Communications by and with Subcontractors and material suppliers shall be through the Contractor. <br />Communications by and with separate contractors shall be through the Owner. <br />ARTICLE 5; SUBCONTRACTORS <br />5.2 Award of Subcontractors and Other Contractors for Portions of the Work <br />Add the following sub -subparagraph 5.2.1.1 to 5.2.1: <br />5.2.1.1 Not later than three (3) days after the judgement of apparent low bidder, the Contractor shall <br />furnish in writing to the Owner through the Architect the names of persons or entities proposed as <br />manufacturers for each of the products identified in the General Requirements (Division 1 of the <br />Specifications) and, where applicable, the name of the installing Subcontractor. <br />ARTICLE 7 CHANGES IN THE WORK <br />7.2 Change Orders <br />Add the following subparagraph 7.2.2 <br />7.2.2 No change shall be made to the Contract Sum or Contract Time except pursuant to a prior <br />written Change Order. <br />ARTICLE 9; PAYMENTS AND COMPLETION <br />9.3 Applications for Payment <br />Delete subparagraph 9.3.1 and substitute the following: <br />9.3.1 At least ten days before the date established for each progress payment, the Contractor shall <br />submit to the Architect an itemized Application for Payment for operations completed in accordance <br />with the schedule of values. Such application shall be notarized, if required, and supported bysuch <br />data substantiating the Contractor's right to payment as the Owner or Architect may require, such as <br />copies of requisitions from Subcontractors and material suppliers, as well as lien releases and <br />reflecting retainage if provided for in the Contract Documents. The form of Application for Payment <br />shall be notarized AIA Document G702, Application and Certification for Payment, supported by AIA <br />Document G703, Continuation Sheet (1992 Edition, ORIGINALS ONLY). <br />Add the following subparagraphs 9.3.1.3 and 9.3.1.4 to 9.3.1: <br />9.3.1.3 Until Substantial Completion, the Owner shall pay ninety (90) percent of the amount due the <br />Contractor on account of progress payments. <br />9.3.1.4 The Contractor's second application for payment shall not be honored until all shop <br />drawings, product data and samples, including approved wood finish sample, have been received by <br />the Architect. <br />SUPPLEMENTARY CONDITIONS 00800-6 <br />
