<br />Inert Disposal Facility or Inert Waste Landfill. A disposal facility that accepts only inert waste such as
<br />soil and rock, fully cured asphalt paving, uncontaminated concrete (including fiberglass or steel rein-

<br />forcing rods embedded in the concrete), brick, glass, and ceramics, for land disposal.
<br />Mixed Debris. Comingled recyclable and non -recyclable construction and demolition materials.

<br />Mixed Debris Recycling Facility. A processing facility that accepts loads of comingled construction and
<br />demolition debris for the purpose of recovering re -usable and recyclable materials and disposing the
<br />non -recyclable residual materials.

<br />Recycling_ The process of sorting, cleansing, treating, and reconstituting materials for the purpose of
<br />using the altered form in the manufacture of a new product. Recycling does not include burning, incin-
<br />erating, or thermally destroying solid waste.

<br />Re -Use. The use, in the same or similar form as it was produced, of a material which might otherwise
<br />be discarded.
<br />�! 3.6.1.1.32 Solid Waste. Putrescible and nonputrescible solid, semisolid, and liquid wastes, including garbage,
<br />i trash, refuse, paper, rubbish, ashes, industrial wastes, demolition and construction wastes, abandoned
<br />vehicles and parts thereof, discarded home and industrial appliances, dewatered, treated, or chemically
<br />fixed sewage sludge which is not hazardous waste, manure, vegetable or animal solid and semisolid
<br />wastes, and other discarded solid and semisolid wastes. "Solid waste" does not include hazardous waste,
<br />radioactive waste, or medical waste as defined or regulated by State law.
<br />3.6.1.1.33 Source -Se an rated. Materials, including comingled recyclables, that have been separated or kept separate
<br />from the solid waste stream at the point of generation, for the purpose of additional sorting or processing
<br />of those materials for reuse or recycling in order to return them to the economic mainstream in the form
<br />of raw materials for new, reused, or reconstituted products which meet the quality standards necessary
<br />to be used in marketplace.
<br />3.6.1.1.34 Waste Hauler. A company that possesses a valid permit from the local waste management authority to
<br />collect and transport solid wastes from individuals or businesses for the purpose of recycling or disposal.
<br />3.6.1.1.35 Construction Waste Management Plan (CWMP). The Construction Waste Management Plan is devel-
<br />oped from the Construction Waste Management Estimation Form and identifies the construction waste
<br />diversion expectations including diversion percentages and tons of the targeted materials and the loca-
<br />tions for the legal reuse, recycling, or disposal.
<br />3.6.1.1.36 C&D Training Manual. A site specific training manual that explains the processes and procedures for
<br />handling the C&D Waste and Recycle needs. Contents include but are not limited to the following:
<br />Materials to be recycled, re -used, or salvaged; Plan and procedure for recycling of lunch and break -time
<br />refuse; and Facilities to be utilized for the purpose specified herein.
<br />3.6.1.2 WARRANTIES AND REPRESENTATIONS. See Compliance Exhibit 3.6.1.2.
<br />3.6.1.3 COMPLIANCE WITH LAW. See Compliance Exhibit 3.6.1.3.
<br />3.6.1.4 LICENSES, PERMITS AND CERTIFICATIONS ("PERMITS")
<br />3.6.1.4.1 Applications for licenses, permits, approvals and certificates. Unless otherwise clearly and expressly
<br />provided in the Contract Documents, Contractor shall diligently obtain, maintain, comply with, and pay
<br />for (solely to the extent Contractor may so obtain), and shall be responsible for the completion and
